Legal matters

Tradesman left a mess - what can I do?

We had our house rendered in May - the work they did was fine and then they came back one evening to tidy up. Everything was wet and looked fine so I paid them.

When the water had dried it became clear that the roof tiles and patio were covered in dried on render. This is impossible to remove without a brick cleaner and a lot of man hours.

I contacted the plasterer who has been very evasive. He eventually came over to look at what he would need to clean it. He said he would be here at the weekend to do it and didn't show up.

He got paid so I can see he has no motivation to do anything. We left him a message saying we would have to take legal action - but is there any legal action we can take? I can use social media in the local area to let everyone know that he has done this but is there anything I can do to get him to clean it up. It would cost us hundreds of pounds to get it clean (we have had quotes).

Thanks.

If the work has not been carried out with reasonable care and skill, and they fail to fix the problem you can claim the cost of getting it fixed from the plasterer. Start by giving them a reasonable deadline to fix the problem. If they don't check to see if they are a member of a trade association which has a dispute resolution scheme you could use. If not you will need to collect evidence to prove your claim, get an independent report on the work (ideally you should get agreement with the plasterer as to who will provide this report) then, when the work is complete, write to them claiming the money, setting a deadline for payment and stating you will take legal action if they don't pay by the deadline. You can then take the matter to court.

Thank you. Their website says they are members of The Guild of Master Craftsmen who I contacted and the aren't - they are now contacting them for misuse of logo.

It's nice to have a way forward.
