Chancel Repair Liability

Can anyone tell me if and how I can find out if a claim for Chancel Repair has been made on a particular house/land?

I suspect that this is happening to one our neighbours and want to check my facts before I approach them!

Difficult to say without outing myself. Could be wrong but I suspect they are being forced into a position to do something that will adversely affect a lot of people. Sad

You can check whether the local parish has a church where such a liability may apply.

There may be new legislation coming to law soon that basically abolishes the whole system of Chancel Repair Liability.

A lawyer can do a search for you to find out if you are in an affected parish for £18. Or you can buy a policy to protect you from a claim (assuming you have no knowledge of liability) for £21.00.

If the liability is registered will it be recorded at the Land Registry. Are you worried you may be affected as well?

Just to add, church councils as charities have no option in law but to register these liabilities if they exist even if they never intend to claim from the home owners. They are damned if the do and damned if they don't (though as church councils I guess they are saved and not 'damned' at all!).

We are in an affected Parish and already have the insurance.

I want to know how I find out if a notice has been served on one our neighbours?

Whether you have insurance or not if you would have received a notice a letter as well if your house is liable. And just because your neighbour has or hasn't doesn't mean the same situation applies to you.
