Can someone take your name off your mortgage without your permission?

Do you know if someone can take your name off your mortgage without your permission?

i.e. they were a joint mortgage holder and then the other party was able to take their name off the mortgage?

If so, is a signature needed by the other person to be taken off or not?

AFAIK you would need to sign to remove someone from the mortgage and the bank would probably need to credit score the remaining person to see if they meet the criteria to pay the mortgage off themselves.

It's been 10 years since I worked in mortgages but I believe if you were to remortgage it would be straight forward to go from a joint mortgage to a single mortgage so long as it was affordable. The only real claim to a house is to have your name on the deeds. Putting your name on a mortgage makes you liable for the debt but doesn't necessarily mean you have a claim to the house.

When I got divorced we agreed that my ex would keep the house and take on sole responsibility for the mortgage. I had to sign the transfer form (TR1) to remove my name from the deeds but he then just remortaged the house in his sole name. I had nothing to do with it and din't need to sign anything.

my friend had this when her husband left. The mortgage company told her that to take his name off would actually mean that she was taking out a new mortgage in her own name, and so it would have to be reassessed. Her ex had to sign to remove himself and then she had to take out a new mortgage.
