Sold a car to a trader...

Could do with some advice please.

I bought a car middle of this year privately. My DH then got a van so we didn't need the car any longer so I sold it on eBay.
A trader bought the car and I thought that was that.
I had a phone call off him last night and he informed me the car had the incorrect mileage on it. It currently has about 60000 miles on it, but he's now telling me that the online MOTs are saying it's had a lot more than that previously.

It sounds like he's sold the car on and the new owner had found this out and he's wanting his money back and informed trading standards.

The trader who bought it off me is now trying to get his money back off me. Now I feel awful,but I didn't know about the mileage and I've just given up work and simply don't have the money to give him.

I've checked the mots and it clearly states that I mileage was altered before I got it.

Where do I stand?
I understand it's not a police matter, but could he take me to the small claims court?

I have no receipt from the guy I bought it off either as it was on gumtree.

He is entitled to claim from you because the car you sold was probably likely not worth what he paid for it since it had been clocked.

As a trader he is obliged to check the mileage before he sells it on.

Is he saying that the mileage is 'not as described? did you mention the (false) mileage in your listing? Usually, if an item is 'not as described' , the buyer returns it, and the seller refunds, but I'm not sure how that applies to cars

Perhaps you'd be better asking on the MN ebay board (here: www.mumsnet.com/Talk/ebay ) , or eBay's own forums, where they have specialist knowledge. I think some of the rules may be different.
