Can I return faulty item without original packaging?

Bought dd dr dre headphones from Argos before Xmas for £118 and after only being used a few times they are not working! The music sounds all warped.

I have the reciept and they are kept in the storage bag they came with but the box got thrown out on Xmas morning.

On the reciept it says they are exempt from the 30 day guarantee.

Should I be able to get them exchanged without much hassle?

They're only exempt from the 30 day guarantee for hygiene reasons- so you cant take them back just because you dont like them. like pierced earrings or toiletries.
you should have no problem!

they're faulty so can be returned, it's not hat you just fancied skullcandy ones instead.

If they are faulty (& you didnt cause fault) you are entitled to an exchange or refund, most companies will exchange and say they dont do refunds for faulty items. Heres a link to sales of goods act, simplified: www.oft.gov.uk/business-advice/treating-customers-fairly/sogahome/sogaexplained

Ok thank you very much, any idea if it would be a straight swap or if I would need to have them sent away etc?

I'm hoping it's just bad luck as other dd has them as well but so far no problems with them.

They're likely to just swap them. You don't need the packaging at all. You could also request a refund, and there should be no problems.

Imho, i would offer you the same or an alternative item up to same value, and refund you the difference. BUT that doesnt mean thats what a manager in another company would do. I very much doubt that Argos will send them off, Ive only ever done that in cases where Im pretty sure they have been deliverately damaged (clothing). At the end of the day, Id want you to come back and shop with us again....

I HATE having to do things like this, why is everything so crap these days? I also have a top to return to river island that the first time my daughter wore it a massive hole appeared in the chest area (not the seam)

Don't forget the receipt though, cos they're not exclusive to Argos. :)
