Tenant signed tenancy agreement but trying to pull out

Hi All, DH has a tenant who was supposed to move in on the 1st Aug 11, she has signed the tenancy agreement but contacted him today to say she no longer wants to rent the property.

The tenancy agreement states that the tenant is required to give 1 month notice in writing.

Is he within his rights to request the 1st month rent from the tenant?

I don't know where the law stands. But assuming he is within his rights surely it's only 2 weeks' rent since it's 2 weeks until she has to move in?

Also, he has 2 weeks to find another tenant so it seems a bit belligerent to me.

Good luck to him in getting the money as well.

Contactually your Dh can hold the T strictly to the contract - which would be his entitlement to the equivalent of six months (or other length of term agreed). However, the cost of enforcing this and likelihood of actually recovering the full amount and any costs would be prohibitive. Has DH accepted any deposit and if so, with what scheme is it lodged?

If not, then I would just put it down to experience and concentrate on getting another tenant in.
