I have just been told that I will have to go back to the same job I had before having dd 8 months ago.
I had asked for a job where I could be closer home as I was based in our office in Birmingham and I used to spend the week up there and the week end in London with dp.
Of course we now have a wonderful dd and I don't want to leave her for the week, commuting is out of question as it wouldn't leave me any time to see her or look after her.
My company is huge and we have offices all over the UK, the head office is in central London, and that would suit me fine. But they have told me that there are no job openings there. OF COURSE (they say) my job is still available! They know that for me this is the equivalent to resign.

Can they force me to go back to my old job?

Lauretta, sorry to hear how you are being treated. I don't think that this is an issue to do with flexible working, because what you are wanting is a transfer and they are saying that there is no vacancy. They are now saying that you are contracted to work in Birmingham and they don't want to vary your contract. Have you got anything in writing from them saying that you could work in London when you returned? Do you really believe that they could find you a vacancy doing your same type of job in London? Have you said to them that you are prepared to take a slightly different role / salary if you could work in London? The first thing you should do is get in touch with head office human resources department and say you are very upset because you were led to believe that there would be no problem in your being transferred to London, and now you have been told it will not be possible. What date are you due to return to work? Is there time for them to look for other vacancies? Remember that there are plenty of jobs out there and if the worst comes to the worst you can find a job with another employer in London. Would you consider working in Birmingham just for a few months while you look for a job in London? Would you consider taking your dd up to Birmingham and using childcare there, and dp could visit you at weekends, just for a few months while you find a new job in London?
