working out pro rata annual leave.....can anyone help?

hi,
i recently had to go thru grievance and appeal process with nhs tryst to get work pattern they promised me before i went on mat leave, then refused when i was due to return....evenutally i won and on three month trial of shift pattern, however since then due to bad feelings i have applied and got another job, i leave on 21st june, my manager says i only qualify for april and may holiday entitlement, ie. two months worth, i questioned this as working three weeks of the next month thought i would get half a months worth????
have searched policies but can't find any answers, is this correct???
also i am due to have nasal surgery (following excessive nosebleeds during and after pregnancy) and need to be off work after, do i have the entitlement to sick leave for this or do i ave to rearrange all my shifts so it is on my days off, they are not being very helpful!

i've come up against this before. if you leave in the middle of a month, you do loose that months annual leave entitlement IME. i therefore would only start a new job at the beginning of a month.

another nhs employee here and manage a team. according to my HR we only pay annual leave for full months, even if you miss 3 days or 14 days. Have always worked on this basis and no one has ever queried it.

sick leave - I would accept sick leave for this as per normal policy. I would suggest you get a sick cert from dr before you leave hospital to cover you. sometimes I've known managers to get employees to take annual leave for the planned days in hospital and then go on sick leave with the sick cert for recovery.

make a phone call to occupational health and get their take on the operation.

make a call to HR to confirm the annual leave. we have a confidential oncall number that can be used without releasing your details during office hours if you'd rather not be identified to start with.

There is a legal statuatory right to Holiday of 28 days FTE (actually 5.6 weeks of what ever your pattern is). However if you get additional enitlement i.e more than the 28 days then they can cut that according to policy (usually to a full month).

The 28 days is a new piece of legislation, it brings together the old 20 days plus 8 days bank holidays.

Sick pay will be according to policy so ask HR but you will still get SSP as long as a GP or Dr signs you off.

Hi in my work you have to work a full month to get that month's entitlement so if you worked for 3 of the 4 weeks you would get nothing.

thanks for all the help, i have to start new job on 22nd cos thats when training starts. bit crap really cos i'm still working for nhs and i'm losing 1/12 of my holidays altogther worth over half a week

in sickness policy it states you can have organised abscences for medical procedure without using holidays but doesnt say any more, i will ring occ health today x
