When is best to resign & what pay will I get?

I am currently 22wks pregnant with DC3 & considering not going back to my current job after mat leave. I noticed on my companys mat leave form there is a option to indicate that I wish to resign. If I tick this box will I still get mat pay & how much?

The other option I've considered is handing in 1 month notice 1 month before return date from mat leave. If I do it this way will I have to pay back mat pay already paid?

Don't resign take leave as you entitled to & give notice 1 month before you due to return, don't forget you can ask for flexible working hours or take some unpaid maternity leave if you want to to help make decision after your entitlement to leave is over

According to CAB handbook "the right to statuatory maternity pay does not depend on you going back to work. You will still receive it, even if you do not go back. You will not have to pay back any smp if you do not return to work."

If you resign at the end of your maternity leave I think you're also entitled to accrued holiday pay for the period you were off.

Resign as late as possible. You are now entitled to accrue holiday during your maternity leave, so make sure you are employed for all of it.
