24 weeks pregnant and being made redundant

Hi , I was looking for a bit of advice/ insight.

I was called yesterday morning by the office manager to say my job was a risk of redundancy along with one other, separate one to one calls were set up for the same afternoon. I've never been made redundant and I have no idea of anything I need to know or prepare for , I accepted the call on the basis there would be further opportunity to consult.

I'm 24 weeks and 2 days pregnant so I have 15 weeks and 5 days until my due due. I have been on furlough for a while now and when I accepted that I was told really my options were reduce hours as not enough work or take furlough with 80% capped pay so not really many options as I also have a 5 year old to home school.

I have today received my at risk letter saying I'll get my SMP, but I assume as I'm redundant I won't accrued holiday or pension payments whilst I'm on maternity?

My consultation meeting is booked for the 25th , I have no idea what to do or if I need to ask anything. Although I've been told no decision has been made it still feels like a forgone conclusion . The letter also stated no other positions are available to be offered.

They only have to give my one months notice of dismissal according to my contract so I'm guessing Ill get that , my outstanding holiday and 1 weeks pay for year year I've work for them.

I did have a read through but my brain is a bit frazzled tbh.

Its only myself and one other.

The company has healthy income and I guess in my head I'm thinking they could have left me furloughed until October when my maternity would kick in which is mostly covered by the government in any case. This would give them 12 months to see if work picks up again.

Businesses now have to contribute more to furlough so there are additional business costs. If you were given furlough as there was not enough work it could be that the business income is not yet enough to give them the profits they had pre-cv

you have to work out whether you have been fairly put up for redundancy and that its not related to your pregnancy as that could fall under discrimination rules. If its only 2 out of 40, what are there reasons for choosing you?

You should ask how it was decided that your position and that of your colleague are at risk.

You should ask whether they can keep you furloughed until your maternity leave starts, on the basis they'll have to fund your SMP anyway, so the additional costs are not high, and this may avoid your redundancy altogether (they are meant to explore options for avoiding redundancy, which doesn't just mean alternative jobs, it means things like that).

Please call Citizens Advice or Maternity Action. They can tell you the correct questions to ask and can help you get the correct advise/payout. The law is very clear about all this stuff but both organisations can explain.
Holiday entitlement & pension payments continue to accrue as normal during maternity leave.
Citizens Advice have a great website for you to have a read on Sunday. Check out the employment section. It is written really well and up to
date & accurate.

Hi @pregnantandconfused1 I’m jumping on your thread because I’m in almost exactly the same boat (I’m 24+6 today).

Do you mind me asking what advice your solicitor gave you?

HI . The issue in all of this is not how many people are being made redundant, its whether the selection of you specifically is fair.

eg a company could make 4000 people redundant, but if you are only the only one at your specific grade then company is on difficult ground.

They have to demonstrate the process is fair, they have used fair criteria related to job characteristics.
