Potential new job paying under minimum wage

Hi, namechanged as worried I might be outed.

So, I had an informal interview this morning which went really well. It's with a small independent family run pub. Boss said she will ring me tomorrow and let me know but I am hopeful and positive about it.

I've been out of work since having my first child nearly 8 years ago now. Second child starts school in September. In this time, as well as being a SAHM, I also went to college for a year and completed my first of year uni. I also recently did 6 months volunteering with a local charity.

I really need a paid part time job now. Every month is a struggle on my DPs wage. Having been out of work for so long has proved challenging with regards to being considered for new employers (no recent experience, no references, hence why I've been doing some volunteer work).

This job has come about through a friend and they aren't worried with references and work history or gaps on the old CV. I think it's and case of they're willing to give me and go and see how ya get on.

I need to bring in some extra income, I need the skills and the experience, I need the confidence, and I just need a way back into employment. It's easier to get a job when you already have a job right?!

My issue is they offer 7p/hr cash in hand. Owner told me 'this is so you don't have to pay tax'. I'm obviously concerned about this as not only is it below min. wage (I'm over 25 btw) but also this gives me no rights essentially. Looks like I wouldn't be on their books, no workplace pension, no holiday pay etc.etc.

I'm concerned if I ask for min. wage they won't offer/will withdraw the job. But this could be a really nice path back into employment for me.

Wwyd? What should I do?

You wouldn't be paying tax working part time at minimum wage.

Do you want to work for someone that flouts the law?

My advice would be to report them to HMRC and walk away.

Agree you would not pay tax or ni on nmw so the benefit is all theirs Hmm They are breaking the Law and it might suggest they cut corners elsewhere.

This isn't a job OP, that would have a job description and a proper interview and at least the NMW. This is CF aimed at just getting a few extra hours to help them out.

Ergh. I feel like my choice is to either work for less than the min. or walk away from it and continue with volunteering (so working for nothing). I need to gain more experience and references which will then help find different paid work.

Honestly? If jobs really are thin on the ground in your area I'd do it for a month to be able to say you have recent bar/till experience.

I don't know that they'd even be able to give you a reference afterwards, because they'd want to keep it under the radar!

fleecedetective that's what I'm thinking. It's not going to benefit me at all walking away and reporting them. I'll have done the 'right thing' though.

Singlenotsingle I want a reference from it. It definitely wouldn't be worth it if I dont.

I totally understand where you are coming from but it HMRC found out anyway you may get hit with a bill anyway for failure to pay tax etc.

Imho not worth it.

You are worth more than this joker is offering. I understand it must be hard to find work but think of the skills you've developed as a SAHM!?! Loads of skills. You deserve a contract, you deserve rights, you deserve a pension, you deserve at least minimum wage too.

Good luck with the search, don't underestimate yourself :-)

Surely that's illegal? You wouldn't pay tax or NI on that wage part time. I'd look elsewhere

Forget the job, you are worth at least the minimum wage! What would you LIKE to do job wise? Have a good think and see if you can find a voluntary position in that field? You need SOME rights in the world of work, crikey it’s an employers market as it is!

Update your skills and enrol on some courses. Hopefully then you will become more employable.

There is no risk to you (eg Hmrc tax) from doing this job unless you are on benefits.
The employer will be the ones at risk as they are breaking the law, and the arrangement is of no benefit to the op as it stands.
