My boss doesn't want to pay me sick pay

Just wondering if anyone can help me at the end of April I fell down the stairs in work(my own fault)and I hurt my foot,I went to a&e the next day they told me I didn't break anything so I just carried on in pain but was able to walk properly but it never got any better so went to the doctors at the begging of June they told me I had torn a ligament and needed to rest it and gave me a sick note for 2 weeks.a couple of my colleges have got in touch with me saying my manager doesn't want to pay me because I've got a fitbit and she seen I've done quiet a few steps more than my other colleagues with a bad foot, she thinks I'm putting it on even though she seen how swollen it was,so I'm just wondering if she is able to do this(sorry if this don't make much sense I've never posted before)Blush

If you have a doctor's note and qualify for ssp they can't not pay it. How would they know your Fitbit record anyway Confused

By sick pay do you mean ssp or company sick pay?

Yes if you've got a sick note they have to pay

I also wonder how they know what's on your Fitbit ???

Oh god that is unbelievably childish that one of your friends told your boss you couldn't be ill coz your Fitbit said you were walking loads. Your friends don't sound very nice

Firstly get rid of the Fitbit (or at least stop it posting to social media), set all your setting on social media to private and keep work and home separate so your boss doesn't get updates about your daily life while you aren't at work.

Next you don't actually know she isn't going to pay you - you just have gossip from some workmates that she's had a chat in the office that your foot can't be that bad because your Fitbit is so busy.

You have a sicknote, you are off sick. If she wants to quibble about it she has to refer you to Occ Health or take it down a formal disciplinary route.

But don't give her anymore ammunition - all further contact while you are off sick should be strictly professional.

Do you mean the company would normally pay company sick pay as per contract? And your boss is disputing?

Or do you mean SSP?

Xposted - you are resting your foot - why on earth did you wear your fitbit, you aren't keeping fit now?????

Also, those friends aren't your friends, they are shitstirring cows.

Switch the fitbit off, ignore the colleagues, block them on facebook and wait until such time boss contacts you personally.

You're entitled to ssp if you have a Drs note.

As of yesterday I'm not longer wearing my fitbit,I haven't posted it on Facebook there fitbit friends if you now what I'm mean,I've rested my foot as much as possible but with 2 kids it's hard to stay off your feet for long there is always stuff that needs doing,I'd also had to go into work to get my daughters birthday presents it was the only place I could get it from, she rang me the next day questioning why is been shopping.

No one else could have bought the gift for you, or online? Rest doesn't mean walking so far it swells again. It is only for 2 weeks so ask others to help you out, with lifts or pick ups. Agree your "friends" are stirring and probably resent you being off. When does the note run out?

Can you say that one of the kids has been using your Fitbit while you're off your feet?

I don't want to lie about the fitbit as I'd properly get caught out.

Fitbit - I forgot I was wearing it. I was resting apart from school run which I absolutely couldn't get out of.

Why was I shopping? - Daughter's birthday. I was hoping ankle was improving and tested it out by going to buy birthday presents.

You don't go from totally unfit to totally fit when your sicknote runs out - there's a process of getting better and getting ready for work and that is what you were doing.

Those colleagues are dreadful.

Apart from my work friends that turn out not to actually be my friends,I don't have anyone else to help me.

There's a huge difference between doing a full days work and the school run. Time to get assertive. And point this out. Take it to their manager or hr if necessary

Your gp is an intelligent and educated professional with a degree in medicine and ten years of study and research behind them. If your gp says that you are unfit for work then your boss who does not have a qualification in medicine can't argue with that and is being very unprofessional.

If your boss says she doesn't believe you were ill then tell her to challenge the doctor and the diagnosis they made.

In any case it sounds like a nasty place to work and I'd be looking for a new job frankly
