Sickness record - HR?

Hi all,

I have recently applied for a new job, and have been provisonally offered the job. The new employer has obtained and accepted my references (including my current employer), but was denied information regarding my sickness record.

The new employer approached me and asked me to obtain this information (which I was happy to do). My current employer has responded stating they are unable to provide me with the requested information.

My question: Can my employer refuse me access to my sickness record?

Is it likely the have refused to provide the information, due to the reason why it has been requested?

Any info would be great :)

Might they have a policy of arse covering for fear of litigation?

It's probably due to the amount of work involved.

It would take me at least an hour to go back through the payroll programme & time sheets to find out what sick pay was paid for hourly paid workers.

We don't even keep records of sick days for salaried staff.

When you say "due to the reason why" what do you mean?
I've found that companies mostly ask if it's okay to give out details of your sick record but maybe your old place has a policy of complete non disclosure, it will be easy enough to sort if they do, but maybe you need to facilitate better communication.

Employment references are getting a bit mad.
