I'm due in October and am planning on taking maternity leave (as I get 12 weeks pay) then after 6 months in total changing to SPL so that DH can take 6 months. No one from either of our employers has taken this before so they are a bit confused by it all.
My questions are: If I was to return then find another job / quit whilst DH is on SPL can I do this without him losing the SPL stat pay? Or do I have to remain with the same employer throughout the year? My terms and conditions are that I must return to work for 6 months after maternity leave. If I return for the 6 months that DH is on SPL have I legally returned to work, or does it not count?
And yes, even if your DH is still taking the ShPL, you are deemed to have returned to work during this period, as long as you actually have returned to work (and you aren't both taking the ShPL at the same time).
