Wondering if an HR expert can help....
I'm on maternity leave, taking the full 12 months which takes me up to end November this year. As I've accrued almost a full years holiday, I stated when I left that I would use all my holiday directly after my maternity leave ended, so I wouldn't be returning to the office until 3rd Jan 2012.
I'm not going back - we've moved which makes it impossible to do a full working day once I've done nursery drop-off and commuted.
What's my legal position, if I'm on one months notice? I'm not sure if I should do
a) hand in my notice soon, to give a months notice before the end of my Maternity leave. Presumably, I'd get paid for the holiday I've accrued until end November.
b) go back 'on the books' as it were, but physically off on leave, then hand in my notice on 3rd December? Then, would I be paid my normal salary for December?
It's probably the same, financially, but I wanted to find out what the 'right' thing to do would be.
