my contract says i get a day off in lieu if i work bank hols but company saying no because i am part time-advice needed

i work 16 hours a week in a shop. I always work tues and fri,although i am contracted to 16 hours a week,which could technically fall on any days, I agreed the days I wanted to work at the interview.

On my contract it says that bank holidays are paid holidays and i will get paid for them. i am presuming this is all the bank hols?
It also states that the shops are closed on bank hols. My manager decided to open on good fri, i am just getting paid my normal rate,plus the pro rata pay as it is a bank hol.

When I looked on my contract it states that if i work a bank hol, I will get a day off in lieu.My problem is that they are saying that this only applies to full time staff,not part time.
Surely if its written in my actual contract then it should be right?

Any views appreciated.

I had the same when I worked for a well known high street pharmacy...they gave me money instead of time off in lieu when I left (I had to leave shortly after a BH)

hi, i used to get mine pro rata over the year. so when i worked 2 day out of 5, i got 2/5 of the bank holidays for that year.

I used to work part-time for a company with a call centre which only closes Christmas Day & Boxing Day. If a BH fell on a day I worked, I had to either work it (but got double time) or take it as holiday out of my annual entitlement; but they worked out everybody's entitlements based on the number of BHs they were rostered to work, iyswim, so eg if my rota included every Monday in the year (& hence most BHs) I was entitled to more hours than if I didn't...

I literally have no idea how they did this Grin

Anyway I think the extra pay that you get for working Good Friday is instead of the time off in lieu - you can't reasonably expect to get normal pay, and extra pay, and a day off in lieu

"plus the pro rata pay as it is a bank holiday" - what's "the pro rata pay"? You say your contract says if you work a bank holiday you get a day off in lieu - does it say you will also get extra money?

In terms of your bank holiday entitlement you get pro rata what the full timers get. There are 8 bank holidays a year (usually!), so as someone working 2 days a week you'd get 2/5 of that, which is 3.2 bank holidays a year. As you normally work Tuesdays and Fridays your best bet is to check the calendar and see how many bank holidays will be on your working days this year. Whether you are entitled to a day off in lieu of Good Friday will depend on whether you will get enough bank holidays the rest of the year to make up your entitlement.
