Ds in hospital , I have no holidays left, don't qualify for parental leave, what are my options?

Ds will be in hospital for a couple more days. Obviously I want to be with him, but have no holidays left, partly due to a mistake by hr. I have been there less than a year so don't qualify for parental leave. What are my options?

I'm hoping my boss will say it's fine but can't be certain of that.

Compassionate leave?

I'm sure there are laws about the right to time off for emergencies involving dependents. Try the ACAS website.

Compassionate leave, I would have thought? Or, at a real push, unpaid leave.

If, though, your holiday situation is an HR error and you're entitled to more then that should be resolved.

Hope your DS is home very soon.

You are allowed to have time off for dependants in an emergency (sickness/hospital admission/school problem etc), there's no bit of law which states how long the maximum time is though. I'd speak to your boss and explain the situation. It's not the same as holidays or parental leave and it's automatic from the first day that you are employed.

I'm sorry to hear about your son, I really do hope he recovers soon.

Compassionate leave, or ordinary leave anticipating next year's allowance. Hope you have a boss blessed with commonsense, and all goes well at the hospital.

Compassionate Leave, I think Employers have to offer this but it doesn't have to be paid.

The hr system allowed me to buy extra holidays, so I had taken my holidays assuming I had more. Last week they told me the system shouldn't have allowed me to buy them and removed them from my allowance. Hence no holidays left.

I assumed I was allowed some kind of emergency leave, but wasn't sure what it would be classed as.

force majeur... dp had to take it when his sister was in a horrendous accident and he had no holidays left.

It depends on how long he's been in hospital I think. If he's only just been admitted then it would qualify as an emergency. I've not seen a thread about your son so I'm sorry if I've given you the wrong info. Most employers are compasionate though.

time off for dependents as per Belle's link is for emergencies only - unexpected situations. You mention that your DS will be in hospital for a 'couple more days', which sounds like it's not an emergency just-been-taken-into-hospital-unexpectedly situation. Emergency leave is to deal with the emergency only, so would usually be for a day or two while alternative arrangements are made.

Having said that most employers would allow you to take unpaid leave. You could explain the situation about the holidays to your boss, and request than in the circumstances, given HR's mistake and your personal circumstances, could the decision not to allow you to buy holiday be reversed.

Ds was taken in under emergency conditions, was hoping to be out today, but he deteriorated a lot last night and they have said he will be kept in fir a couple more days as not managing to maintain his oxygen levels unaided atm. So definitely an emergency and not planned.

Sorry to hear that. Definitely an emergency then, but in any case it would be a very harsh employer that tried to force you into work.

Thanks everyone. My boss was fine and said to take as long as I needed. I hoped he would be, but he has been a bit funny about a couple of other things so wasn't sure about his reaction.

DS has pneumonia and it looks like he will be in hospital till at least Wednesday as every time they remove the oxygen supply his blood oxygen drops too low.

We just got home about an hour ago!! Such a relief that DS is so much better and to be home and really looking forward to sleeping in my own bed for the first time since Thursday.
