Paternity rights help, please

Hi,

My husband has been an idiot and not given notice of needing to take paternity leave. I'm due in 2 days.
He has also just quit and is on a months notice from last Friday, ie 3 weeks left at work roughly, of which 2 should be paternity leave.

So his employers are now a bit annoyed (!) and have suggested a compromise of one week paternity leave then back to work. Can they do this? Or must they let him take two despite lack of notice? They would only pay for one week anyway, then statutory pay for the second week.

I am quite cross with him! And could really do with him being off for two weeks as we have a 2 year old as well. But at least if he goes back after 1 week we'll have more money.

If there's no valid reason for not giving the right notice he is not entitled to take it at all. His employer's enhanced scheme whereby they pay him for a week of it is subject to whatever terms and conditions they put on it, and I imagine he has not met those so they could refuse that as well. I would suggest he takes the offer tbh.

Does he have any holiday left?

Thanks flowery, just found similar on directgov actually, should have googled first.
Yes he does have holiday, 2 weeks worth in fact, but they don't want him to take those either as then there would be no handover at all.
Will have to suck it up I guess! And moan at him at great length.

Flowery is right I'm afraid. You need to whallop (not literally, not condoning violence!) your DH, the company has not done anything wrong and they sound like they are being ok aobut it in the circumstances.
