Power of attorney issues with Mum's bank

Hi, my brother and I are trying to register to run Mum's bank account but are hitting a brick wall. The POA form is worded with substitute provisions for me and my brother to manage the Mum's affairs if Dad is no longer able to do so. Dad passed away a few years back and we assumed that we would then step up to take his place. Mum's bank will not accept the POA as it has Dad's name on it - despite the provisions described above. They want an amended POA with no mention of Dad before they will consider our application. Any one come across this before?

I don't know the answer but have you rung the office of the public guardian to ask if they can help. You could ask for a third party mandate form which your mum can sign instead which should help you manage her bank account for the time being. You could also try and ring the banks bereavement line for advice. The only thing I can think of is that it is solely in your mums name now. Good luck.

Was it an official form or a letter outlining the request?

Slightly different but my DSis and I had problems with the bank not accepting our Guardianship certificate. Can't remember the ins and outs as my DSis was dealing with it but it was also a wording issue. We took advice from Office of Public Guardian and relayed it to the bank's legal department who eventually backed down.

Retirednow - think I will try the 3rd Party Mandate as a stop gap as I get the feeling this is going to drag on a bit. Tried to get through to the POA bit at the bank today but they only deal with internal staff. The person I spoke to in the public facing section didn't have a clue.

Fekko - we have a LPA form that was registered with the Office of Public Guardian in Jan 2009. Dad planned ahead!

Fortysix - I think I will try the Office of Public Guardian next; I'm glad it worked for you and your sister. The person I spoke to today at the bank was suggesting we scrap the current form and start again, but I'm reluctant to do that after it was apparently 'future-proofed' when it was created. Feels a bit like they don't know their a* from their elbow.

I have also finally managed to get hold of Mum's solicitors who drafted it to see what they make of it.
