PROOF OF POSTAGE !

i bought an item of ebay as a buy it now for £100-- item hasnt arrived yet (fair enough due to postal strikes etc)however seller did not send as recorded delivery as stated in listing! he emailed saying he doesnt have tracking number but has proof of postage! r these the same thing ?
if i didnt receive the item for watever reason does the "proof of postage" cover me ? i havnt a clue
please help x

did you pay by paypal? You can file a claim witht hem, and they will refund you. Proof of posting won't defend him against a paypal claim if it isnt recorded.

He can then use his proof of posting to claim from royal mail to get his money back.

IIRC Proof of Posting only covers an article up to approx £35

Norbert is right. Proof of postage just means that the poster got a receipt from the post office, and is evidence that it was sent, and one is insured to £35.00.

Am fairly sure though that it's the seller's responsibility to get the item to you rather than vice versa.

He wont get £100 from Royal Mail if he only has proof of posting, but that really is his problem not yours. Send a polite email, then put in a paypal claim immediately if the reply doesnt promise you a full refund. It will side with you, esp if he stated recorded delivery in the listing.

well i have emailed him and he replied that he will wait for a few more days (which i dont mind)then he will claim through royal mail as he has proof of posting to prove he posted it ! ! ! he will issue my refund once he has received it back from royal mail ! i think this is some kind of ploy to delay me making a claim with paypal as i only have a certain amount of time to claim....
im worried that because he has proof of posting paypal know he is genuine and did send it even though i havnt received it IYKWIM
its really outting me off ebay

I would just put a paypal claim in now, it can always be cancelled if the item does turn up!

Put claim in now before he empties his account!!

he should refund you now and not make you wait until he has claimed.

Paypal will not accept proof of posting, when you put in your claim through paypal do not mention the POP just say that you have requested the tracking number for the recorded delivery as per the postage conditions but have been infomrmed that there is not a tracking number available.

It is about 99.9% certain that you will win being the buyer in any case, the fact that he has not sent recorded pretty much eals the deal. Get you claim in as soon as you think you have waited long enough for royal mail (usually 2 weeks).

The way paypal works is he has to prove that you received it, not that he posted it. If he can't prove you got it, paypal will refund your money right away, and afterwards he will have to fight it out with Royal Mail.

What EJM says, you can open the paypal claim now and not do anything further about it for a bit.

How long ago does he say he sent it?

Also, he wouldn't be covered sending it recorded either, that is up to £39. He could have course sent it standard parcels and paid for extra compensation so he WOULD get his money back from RM then, but still not covered by PP. he would have had to send it by courier or special delivery. Not your problem though, submit PP claim.
