she wants a refund! sake!

I sold 8 highland dance items on Ebay.

They all sold and were paid on the same night. 3rd October.
As they were full kilts and very heavy i arranged a courier to send them. They were collected on the Monday and off they went.

So one went to Canada, one Bewrick Upon Tweed and the rest were all very close to me. 3 ladies picked up and the others were all really close. I live in Central Scotland.

Anyway getting to the point. I got an email from a lady who bought one outfit (full kilt with blouse, matching heavy socks and velvet waistcoat) Saying she wasn't happy with the kilt as it wasn't new. BUT she also bidded and was outbidded on another kilt i was selling and only bidded in the last minutes.
I didn't say it was new and listed it all honestly. Everyone else was happy and has left + feedback, and one lady who came to collect was begging me for other outfits as she had been outbidded.

So the winner im talking about lives close to me. I hadn't heard back to her sinse replying on the 9th untill today. She says the kilt was altered ( we had it made to measure) and she wants a refund. but i listed all the measurements. I told her i wasn't refunding as i listed everything honestly and that i didnt say it was new.

I am thinking.. tomorrow is the last day of The Mod week. www.mod2008falkirk.org/ It really looks to me like she has wanted it for this week only ( i could be VERY wrong) But lots of schools have been doing things and there are kids everywhere in kilts. I hadn't even heard of it but my work was full of children dressed in kilts - in the hundreds easily.

What should i do? I listed it honestly, all the measurements were exact as we had it all hand made. The kilt at a kilt makers and the socks elsewhere ( and they were £30 PER SOCK) Waistcoat was made by a dance shop. All in all it cost over £600 to have made and the seller got it for £128. There was a photo on the listing.

She paid by paypal, but i withdrew the money because it was for christmas shopping.

She bidded on another outfit too but was outbidded in the last minutes. Could she have wanted the other one more?
I have 242 posative feedbacks 100%. I always sell honestly and have never had a problem.

if you listed honestly I don't think paypal will give her a refund

did she pick it up in person?

i cant find any photos but there were hundreds of kids and adults in kilts in my work all week.

I would reply poitely including the description, and asking her where she thinks it differs from that.

Have you left her positive feedback?
Can you open a dispute as a seller - beat her to it? You should still have the ad so I would paste it into an email to her and point out the measurements. Did you list it as used anywhere on the ad?

If she really wants a refund then tell her you want it sent back first class post, in pristine condition, so you can re-list it as a second chance bid. And I would leave negative feedback for her too.

Don't pay for her postage fees. It is eBay and all stuff sold on there should be considered used unless otherwise stated. The item is not damaged in any way and if she went into a shop to return it, they wouldn't be obliged to give her a refund - point this out to her too.

yeh i have proof, i used DHL to post it because it was heavy. I have the recipt from the driver and emails too.

It was in oerfect condition. My sister wore it as world champion throughout europe and their outfits were often inspected. They were deducted points if they were unkept.
It was made to measure also so the alters on it must have been by the kilt maker.

If you refuse to refund her (which i would) then she will go to paypal and start a dispute to get her money back, they may end it in your or her favour. I would let paypal be the judge, you will get your say so explain that the items were not desribed as new. Shes just trying it on.

It wasn't damaged, but it was used.
I didnt say it was used but i did say 'this fitted from around 9-12 years'

In the Ebay description box it clearly says Condition USED!
I don't think Paypal would give her a refund.

If I was looking at a seller with 99% good feedback, I'd presume that she was still reliable.

You haven't actually said what condition it is in on your description (other than 'used') so really it is a case of caveat emptor and she should have been emailing you with questions prior to the auction ending!
I would have if I was spending that amount....
Yes- it looks excellent from photo.
All the measurements are clearly there- you are not at fault here.

Says used in the ad, all measurements there, bidders invited to ask questions. She cannot demand a refund.

You know, I find the eBay forum very helpful at times like this. Other experienced eBayers will give you advice on what to do as many of them will have been in this situation.

I havent heard back from her, although i did reply as soon as the email came through.
It was in lovely used condition, but was used and in no way brand new. But it is not like it was used every day or anything. I sold another full kilt and 6 other outfits which were also worn at the time.
And i advertised them on here before i ebayed them too. I buy and sell a lot on here.

let her open a dispute if she wants to. respond to the dispute with the simple facts (paypal staff don't like reading through loads of waffle)
paypal could find in your favour and then you don't have to refund. If they find in her favour she will have to return trackable at her own expense.

you have a strong case, stick to your guns.
if responding in a paypal case mention those events dates and say (diplomatically) you wonder of she just needed the item for the event and thought she could 'borrow' them

As you didnt change the box to say 'Returns for refunds accepting' (or something along those lines) you dont have to refund her.

If she leaves bad feedback you can put a comment against it saying that she didnt read the description properly.

My dd has recently given up highland dancing (we live near Edinburgh), so I know a bit about these outfits, having spent a FORTUNE on them over the years

Your buyer got a bargain at that price, I sold my dd's outfit for £225, and would have asked for more had it not been a friend who bought it.

Don't offer her a refund, hopefully Paypal will find in your favour - you did list the outfit as used, and gave measurements so she hasn't a leg to stand on.

heard from her today, she is now saying that there is a hole in the kilt(never mentioned that before). There defo was not a hole in it when i sent it out. It was made for my sister, my parents spent over £600 on it so it was VERY well look after. I am really sad because it was well loved and it sounds like she may have damaged it.
I have told her to open a dispute but i am really worried i need to refund her and end up getting a damaged outfit back.
