I am so cross with paypal over an ebay business seller.........

We bought an item worth £500 a few months back and after waiting a lifetime for it to arrive (it said 2 in stock and expected it within the week but it was actually 4) - when we found out the delay we tried to cancel but guy said if we did he would charge us materials and delivery anyway
The item arrived the wrong size (smaller) than advertised - and quality made safety an issue, the seller admitted size issue and offered £50 refund as compensation but we refused it as at the size it is off no use. He refused to take it back so we raised a dispute with paypal and really tried to work it out with the bloke who is just so unreasonable ignoring calls etc...... paypal asked us to return the item by a date which we aimed to do at our cost of £50. Teh guy was not answering calls from delivery company on his mobile or in on the 3 attempts up to the deadline date and on the day after the deadline date when they finally gained access to his premises he refused to accept delivery. We now have to foot the bill another £50 to have it returned. We supplied info to paypal showing delivery details of the return and that the person refused to accept delivery. Paypal have now emailed and said they are closig the case as the tracking info is insufficient - wtf? i am soooooooooooooooooooooooooooooooooooooooooooooooo hacked off. We are in contact with trading stds who said the guy should have paid the postage anyway and we should persue through small claims court as this is the only way now. Is there an appeals procedure with paypal claims or is it just tough luck and another crudtastic thing to add to my week? Has anyone had anything similar with a happy ending coz i loove happy endings.

Because you don't actually get to see the item you're buying until it arrives you have a statutory right to return the goods for a full refund if it is not what you wanted - even if not faulty. This applies to online shops including ebay shops, although I'm not sure how it works if the person you bought it off on ebay is a private person rather than a business.
