Partial return of faulty goods bought on Ebay

I bought two lengths of fabric on Ebay from a business seller - they were a well known, fairly expensive brand and sold cheap(ish) as they were marked. Seller said marks should wash out.

I make items out of fabric for a living and sold a few (using the unmarked parts) before I realised that the fabric had an undisclosed fault - the dye runs as soon as it comes into contact with water. Some enquiries have established that the item is genuine, but something has gone wrong with it and it should never have been on the market at all - it is definitely not supposed to do this.

I'm in the process of contacting my buyers to explain/apologise and give a full refund (they get to keep the items).

My question is - can I reasonably expect a full refund from the seller? I will be returning approx 50 - 60% of the original amounts. They cannot use the returned fabric for anything and it wouldn't be feasible or help anyone for me to recover the faulty items and return them as part of the original fabric length! I've raised cases but the responses so far have been a bit disjointed and vague.

If you go by eBay rules then you have to return the entire item to get your refund.

The seller is under no obligation to accept / offer any terms apart from a full refund for a return of the complete item.

HOWEVER I'd just return what you have and there will be an option for the seller to "decide how much to refund" when they come to refund you. They can offer you a lesser amount that full and if you're not happy with it you can ask eBay to step in and help (if you're not happy ebay will generally give you a 100% refund anyway)

Realistically you could just return what you have and force them to refund the full amount, but it's up to you if you want to do that.

Personally if this was me I would call up the seller and discuss it with them over the phone and hopefully you can reach a satisfactory agreement and then proceed with it.
