What does the label say about washing? And what did the listing say?

Is it second hand or a brand new item from a shop type seller?

I would say if it's second hand seller no chance but maybe if it's new from a shop then you might be able to...

Said wash on 40 but I hand washed it.no was not new oh well guess I will put it down to a loss.

You can open a not as described case and let eBay decide.

fieldfare · 18/05/2016 16:01

No.
It's not the seller's fault that the dress is now damaged.
I'm assuming that it reached you in good condition? If so then that is the point at which you become responsible for the item.

summerwinterton · 18/05/2016 16:31

No, sorry not true at all - if the buyer followed the washing instructions and this happened then it is a faulty item. That is why you have so much time after receiving an item to open a not as described case. How would that logic work if something only functioned for a day then a fault appeared the next day. Your statement makes no sense at all Fieldfare.

I think this comes down to whether washing instructions on the garment were followed to the letter and even then I would be inclined to put it down to experience rather than say seller was at fault here. If it was bought from a shop and I had washed as stated on label then yes I would take back to shop. But I wouldn't do this for a second hand ebay item. I think that this would be a bit unfair. As a seller I would be miffed if someone did this.

If buyer followed the instructions (or was more careful) then of course its a faulty item, and therefore she would be entitled to refund/replace

It makes perfect sense, you just disagree with it summerwinterton.
It's not a faulty electrical item, it's a second hand dress.
In my opinion, if the dress reached you in good condition, as described, then anything that occurs after that point - colour running, you snag the fabric while wearing it etc, are your responsibility.

It's not OK to sell defective items even second hand.

Unless it said dry clean only, or don't get wet and she washed it, she has a defective item which is not for for purpose

Colour running - defective
Snagging or ripping - owner issue

Report
MyLocal · 20/05/2016 07:23

It's a second hand dress, so presumably its previous owner washed it at least as robustly as hand washing and the colour never ran.

Sorry I don't think you hand washed it and you are gutted you spoilt it so are hoping the seller will take the hit.

I have wrecked things that I have just bought through being slack with my washing too, it's shit but it's not the sellers problem.

Report
Fuzzywuzzywasabear · 20/05/2016 07:23

It's second hand, it's not the seller's fault the colour run.

Was it used? Because presumably the seller will have washed it without the colour running previously?

Report
SoupDragon · 20/05/2016 07:29

I agree - it's a second hand dress, presumably washed and it is not the sellers fault the colour ran. How is this "not as described"??

Report
ThatsMyStapler · 20/05/2016 08:56

its "not fit for purpose" - its a dress and therefore designed to be worn and cleaned? its not disposable is it? did i miss something in the description?

did it say dry clean or wash at 40? its reasonable to expect that if you buy a dress that the colour doesnt run. It doesnt matter where you got it from

Report
SoupDragon · 20/05/2016 10:08

The dress is second hand and white. It's reasonable to assume the original owner has washed it with no problems and thus it is not their fault.

Report
ilovesprouts · 20/05/2016 17:33

mylocal yes I washed it by hand I'd already done the washing for today so hand washed in warm water like the label said.
