Seller refused return by refusing the parcel

I bought a top described as NEW. It arrived, smelly, very worn with seams coming apart and not new. Aggressive seller said it was part of the design. Requested return with photos and got a return address. I sent it recorded delivery and it looks like it is coming back from her, undelivered. I am guessing she refused delivery.
I don't want to try again but am angry that she has done this as now I am stuck with the item. Is there anything I can do? I'll have paid more in postage then what the item was worth but am guessing she knows that.

you open a dispute, enter the tracking and eBay should refund as there has been an attempt to deliver. And please neg and leave low stars - what an awful seller.

Once a case has been opened, ebay customer service are often helpful for getting a quick resolution if you ring up and explain what's happened (the call centre staff are much more use than the LiveChat people). Twistleton is right, the tracking number should be enough for them to action the refund as there has been an attempt at delivery. You shouldn't have had to pay for the return postage, either, as the item was not as described. Don't forget to leave negative feedback.

Thanks people, waiting for it to turn up now. I can't even sell it on as I don't think anybody would buy it!!

What a terrible seller. Do open the 'not as described' return case straight away, I'm sure you don't even need to wait for the item to come back to you because you have already returned it and can simply enter the tracking number for that return. If you ring up, customer services will help out. There'll be no need to communicate with the seller again. Hope you get the problem solved!

You do not need to wait for the item to be returned before opening a case. The post office keep the item for 18 days after attempted delivery before returning to you. So you are well within your rights to contact ebay once you have given them enough time to collect the parcel, ebay will see that delivery has been attempted and should refund you.

I requested a return and sent item back to the address provided. The seller refused any further communication with me, she also refused to pick the package up from post office and to refund me.
I escalated after 8 days of attempted delivery and Ebay refunded me from her account within 15 minutes of contacting them without requesting the tracking number, quite simply because she refused all communication and didn't respond to the request.

I eventually got the parcel back, still no communication so I kept it, this was back in March and last week Ebay sent me a £10 voucher to use on any purchase for my trouble!!!
Was a complete hassle more than anything but worth it in the end as I gained way more than I thought i'd lost on the return postage costs!!!

Hope you get it sorted if you haven't done so already.
