Some advise needed as a buyer

I am new to eBay and need a bit of advice. I bought a toy for DS, it arrived and was very dirty, but plastic so easily cleaned, also it arrived without batteries so I had to wait to give it to him a few days until I could get some. I guess these two points are fair enough, easily rectified, but we got it working today and it doesn't speak English! The toy has 3 buttons, 1 has English catchphrases and the other 2 are Spanish.

I have done some research and these toys were made in other languages, which I have obviously bought, no mention of this on the listing for it. I have emailed the seller today, no response yet. How long should I give it? What can I expect from them? Its not a cheap toy, nearly £30 so I'm a bit miffed.

It sounds like a reasonable case for return for full refund, is that what you want?

Don't say you cleaned it, this will undermine your case (makes it seem like you accepted it as is).

Batteries: hard to send containing batteries now, anyway! So weak grounds for complaint on that.

But if the multilingual aspects seems to you like an annoying problem then go with that. I would try to contact seller informally first to explain why you're unhappy about the multi-lingualness. From there build to returning for full refund.

Thanks for responding. I didn't intend to complain about the dirt or batteries it was just an annoyance really.

I was pissed off they hadn't said it was Spanish, my DS loves it and has gone to bed with it, I don't know if I can take it from him! Maybe I'll get him another one to replace it before I send it back. So I should be able to get a full refund if I send it back, that is probably what I'll aim for.

You are entitled to return for a full refund, under ebay rules as the item appears not to have been described fully.

If you do not hear back from the seller in a couple of days, open a case against them with ebay and advise you are returning for a full refund. You will almost definitely have to pay for the return postage and it will be unlikely that you can recover this cost.

When you return it, use a service that requires a signature so the seller cannot say they have not received it. Once they have received it back, give them a few days to refund you. If they don't do that then continue pursuing the case through ebay and you will receive the refund.

You can open a case and do nothing until the seller responds back to you. If they do not respond in anyway you may get a refund and get to keep the item.

And, only contact through ebay. They will take no notice of any correspondence using other mediums. And if you do open a case, only converse with the seller through the open case system.

Thanks all, yep it's Buzz! I still haven't had a response to my second email, so I'll open a case I think. I don't know where to send it back to as I don't have their address.

Doesn't Buzz turn Spanish when he gets reset in TS3? I think personally if your DS loves it I'd keep it as a bit of a novelty, added to that the ability to say 'To Infinity and beyond!' in Spanish is incredibly cool.

I'd push for a partial personally.

I though there was a switch on the back that makes him go Spanish? So you can also turn him back to English speaking?

Am remembering this from a friends' Buzz though so could be wrong.

I can't see any kind of button which would unSpanish him. I haven't heard anything since I opened the case, they have until Tuesday to respond it says so will wait and see what happens.

It is quite cool he is Spanish, but I was pissed off that they didn't mention it in the listing, my DS is certainly pleased with him.
