Hello all just want some advice my ex wife and I are going through a divorce we have had are decree nisi but I have noticed it goings on about stuff you can not do once divorce is final and one of them is - If your spouse has appointed you to become a guardian of their children on their death. A divorce will deprive you of any right which you may have to act as a guardian (unless your spouse specifies otherwise. My daughter stays at her mums a week and then mine a week my question is if anything happens to my ex wife will my daughter stay with me permanently it’s just got me really confused

Do you both have parental responsibility for your daughter? If so that doesn't change. What it is talking about is if the child is your exes child but not yours

Of course. If one parent dies, the child will definitely stay with the other barring abuse etc.

If your concerned have it drafted legally before discussing money. Or afterwards if already done

When making a new Will, it is good to put in that if you are the surviving parent that had parental control, who you would like the guardians of your child to be on your death.
