Need advice on Seperation!

Hi All,

After 11 years of marriage me and wife has decided to separate as it's not working between us.

But the problem is she want me to still pay all the bills, mortgage and insurance even after seperation as I am currently paying all that because she works part time sometimes, so even it's joint mortgage she is refusing to pay and currently she pays for food and other kids expenses.

She said I will never let you get divorce and you can never get remarried without my divorce consent.

We have 2 kids. She is ok for me to see kids on weekends.
She is not working currently.
I only work.

So please advice me on following :-

  1. Can she claim govt benefits for childcare and other credits if we are seperated?

    2)Is this a rule that after separation if she do not sign divorce docs, I won't get remarried?

  2. Is this a rule that I have to pay all bills, mortgage and insurances even after seperation?

    Please help?

Start divorce proceedings. That’s the only way you can dirt this with a financial consent order. She’s in for a shock

Are you in the UK?

Your wife can't act like this. You can get a divorce even if she doesn't agree. You can get remarried after you're divorced from her.

You do not have to pay her costs like housing. She needs to get a job and claim government benefits if her income is low.

If you have children you must pay Child Maintenance. There is a Child Maintenance Calculator so you know the minimum payment. That money is for her to spend on the kids when she looks after them. You pay the cost of looking after them when they are with you on top.

Your wife can't stop you divorcing or remarrying and she isn't entitled to any of your money. Start proceedings now, and try to negotiate child maintenance with your wife - if she won't negotiate go through the CMS.

You don't need permission to divorce in the UK. See a solicitor but she is incorrect. You don't have to support her forever. She needs a job quickly too.

    Yes, if her earnings are low.

    No that's false.

    Also false -- though you do need to reach some kind of agreement about whether there is ongoing support (though child support does have to be paid, according to a set formula).

    She's in for a rude awakening -- anticipate a difficult time.
    This relates to England/Wales practice/law.

All she is entitled to is child maintenance and 50% of any of the marital assets.

You can apply for a divorce without her consent
