Hi there, I posted recently about my shitty situation following domestic violence. As an update, he still hasn't been in touch, however I've been to sign the divorce petition today.
Ultimately I don't know as he has the money to take me to court for assess to our 10 month old baby, but if he does I will defend it as hard as I can, because he has proven to be unstable, violent, aggressive and unpredictable. I will not allow him anywhere near my son.
I want to keep his surname because I want it to be the same as my son's, and I don't really have any qualms about it being "his" or relating to "him". I don't want to put my son through a name change before he's even a year old - I doubt STBXH would agree and can you imagine the paperwork?! I want to keep things nice and simple.
Trouble is, my passport is still valid from before I was married, and so it is in my maiden name. If I was ever to take my son on holiday, the different names would be a red flag and they may ask for proof that I have been given permission from his father to take him away. So, I'd like to change my name on my passport, for which I'll need to send them my marriage certificate - which my solicitor has and the courts will soon have. But will that even be valid once I'm divorced..?
