Hello lovely people I need some advise for my daughter she has been with her partner for 10 years married 8 weeks separated 4 weeks he confessed because he had to that he had been having a affair for 8 weeks before the wedding and the OW was pregnant and threatening to tell my daughter. My daughter is totally devastate and has cried for the past 4 weeks everyday she finds it difficult to sleep and when she does she has nightmares about them I have taken her to the doctors and they have given her sleeping pills which are a bit hit and miss. I just dont know what to say to her any more as a mum all you want to do is make it better and I cant. My questions are should I arrange for her to see a counselor secondly she cannot get a divorce for 1 year could she get a legal separation now thank you

Your poor daughter.
Her husband sounds like an idiot.
Not sure of the legalities but would they qualify for an annulment if he was having an affair at the time of the marriage?

Four weeks isn’t that long to process a huge betrayal. I’m sure she’ll rally given a bit more time. Just carry on being supportive.

As I understand it, judicial separations are uncommon. But if she wants one to help draw a line and maybe to help evidence the separation for the later divorce, then I think it’s quite cheap to apply for one directly to the court. I know the forms are near identical to the divorce petition forms because I helped a friend fill a set in (religious reasons in her case).

You could also ask on the legal matters board if you want some legal guidance.

Hi biscoffbaby she cannot divorce for 1 year if she had been pregnant by another man he could have got a annulment but because he has got someone else pregnant then it does not work that way he is a total emotionless prick

Ridiculous that it only works one way isn't it.
I've no practical advice to offer her then but hopefully the reassurance that most men are not like him

She could apply for judicial separation but there's probably no real legal reason to do so in her circs.

Do they own property jointly?

It's no doubt far too soon for your daughter to take this consolation, but thank God It's OW and not your daughter who is saddled with this lying idiot's baby.
