Divorce/separation

Transfer of equity before financial order?

A month ago I found out my husband had a 12 months affair. We decided to divorce and I sent my petition in a week ago. I didn't know anything before then about the process of divorce but now I've looked into it I'm really struggling with the possibility that it could be months before we get our decree absolute or even get to the point of sealed financial order.

We've agreed our finances and I would like to go ahead and buy my husband out of the house so he gets enough money to move out - until then we're stuck in the house together and pretending in front of the kids. I just don't think I can do this for months.

Can anyone tell me, is there any reason not go ahead and change the mortgage and give him the money so he can leave? (I've had a DIP). Or would I be daft to do this before I get my financial order and my DA. My husband won't come back for more equity I'm sure.

Thanks to anyone who can help. I hadn't realised what a marathon this is!

Thank you very much, that is really helpful information. The draft consent order and D81 sounds the way to go.

I'm not expecting him to come back for more, but then I didn't expect to be in this situation five weeks ago, so I guess caution would be sensible...

Thanks again.
