D8 query re adultery statement and financial order

Hello, I'm filling out form D8 to start divorce proceedings today with a heavy heart but a clear enough head, (at least that's how I feel right now!).

Can anyone help with a couple of specific questions about the form - I've looked at the guidance but still not sure.

1. In a free half hour appointment a solicitor told me to include an admission of adultery from my husband along with my form, and also get him to state he will not defend the divorce. Does anyone know what difference this will make, and what form of words we should use? (He knows I am citing his adultery as the grounds).

1. Should I tick the boxes in section 10 regarding Financial Order for self and the children? We intend to agree our asset split ourselves and then to get it signed off as a consent order pre decree absolute. I'm not sure if ticking these boxes means that I am allowing this to happen, or if it means I would be asking the court to decide my asset split which I don't want to do.

Hi - I was advised to tick all the boxes as it doesn't commit you to anything but if you don't then you can't go back to it later. I was told that on here and happy to pass it forward. Good luck.

Yes tick all the finance boxes.

Don't issue on adultery unless he has signed an admission (the court doesn't need it, just keep it in case he fails to cooperate)

If he won't sign, go on unreasonable behaviour.

Thanks MrsBertBibby, that makes sense. He's said he'll sign a factual statement so hopefully that will be alright.

Oh and I'm doing what you propose. I've got my decree nisi, we've agreed finances and I'm seeing a solicitor tomorrow to go over the proposed consent order to check it's all as it should be. Then I will sign, he can get it sealed by the judge whereupon I will apply for the absolute.
