Clean break

If you haven't had your clean break after your divorce, do u have to get one or does getting re married just void it?

It's just my partner is divorced but didn't do the finances as ironically a lack of finances. There are no assets and just need to get that clean break but his ex wife will not sign the paper work. Not sure how we are able to move on if she won't. Doesn't seem fair.

Thank you . It is fair. a rented house. Only a 2 year marriage. They spent all of his pension payout doing up and buying things for the house. He doesn't want to claim from her for any of the goods in the house or her pension. No children from the marriage.

Best piece of advice I was given at the start of my divorce process was " get a solicitor and get a clean break otherwise it will haunt you for ever more".

Friend of mine didn't get the clean break before Decree Absolut and now is being strung along by his ex wife (who is still living in the marital home after splitting up from the person she had an affair with at the end of the marriage) who will also have rights to any death in service benefit and his pension! So for the sake of not spending £2-3k on getting the financial order sorted by a solicitor it will cost a lot more in the long run!

I know but at the time no money so did divorce which she agreed to straight away. But now she won't sign the paperwork or reply to e nails. There is no martial home it is rented and no assets. Just don't understand it. Can't turn clock back and do after nisi. We have made an appointment now with a solicitor to see what to do next.

You must get it idealyl. Remember that penniless energy company hippie who didn't (or got it and lost it)? 20 years later his ex wife came back out of the blue and claimed millions. Also that lawyer had been remarried for 20 years and his ex wife from a divorce decades before was able to come back and get more money - they had not had a clean break.
