Divorce - Transfer of equity - tr1

Hi , does anyone know if my friends stbxh has a right to know what her new mortgage offer is . Her mortgage offer expires soon And he is now saying he needs to know before signing the transfer of equity form . Thanks !

I am in the process of transferring equity to my ExH. I have no details of his mortgages and whilst I don't want to know his solicitor has been very clear that they are confidential.

It should not affect the transfer of equity,.

My oh is being bought out of his ex's home. He has only seen paperwork saying how much he will be getting from the remortgage as part of divorce. He has not seen anything else, I would imagine as its 'her' business it can remain confidential.

No obligation to show it. My ex wasn't shown mine (I bought him out and remortgaged). However I would not have been bothered had he wanted to see it and he was still living in the same house until the bitter end so might well have seen it.

I suppose if an issue in a court hearing was what can your friend borrow and there were doubt about it then it might be something a judge might order should be disclosed. If there is no reason to keep it secret in general I favour openness. If he will twist anything round and make a big fuss over it then don't show him however.

Can anyone advise I have a stamped consent order dated 18 Dec 2014 which states my ex had 28 days to transfer property over to me which he failed to do I spent months writing to him no joy 1 year on he went bankrupt I fought them and won I filed a d11 and ask judge to sign she decided to order him to do it and sent it to him he failed I filed a d50k and asked the judge again this time she signed it but now the land registry tell me they won't do it as ex has two charging orders on the house for loans and need a letter of consent from his creditors the judge made it part of divorce settlement that he took full responsibility for the loans and he signed a under taking to the court as long as I agreed to give him 5 years to pay them off which I agreed as wasn't advised it would stop the tr1 but 2 years on he has stopped paying them so no way will they give consent and I'm stuck with him on the deeds does anyone know how I can get round this the 3 year legal battle has broke me I can't afford any more legal cost as he has also breach on maintenance aswell been back to court twice they give a Order he must pay in 21 days and he still refuses I lost faith in the system seems the consent order is worth nothing he does as he likes

Thanks babybarrister but due to his lack of co operation my legal cost mounted 8 grand in total and I'm no further forward my little boy has gone without enough for far to long I can't take on any more cost I carry on searching the net thank you
