Friends car crash dispute

Names obviously fake.

Alice was driving her car with Jenny as a passenger, and they had a crash, the fault of another driver.

Alice's shoulder, already damaged, got worse so she applied for the forms to fill out for compensation. She encouraged Jenny to do the same.

Jenny filled hers out and received 600. Alice decided not to bother, even though she would have been entitled to much much more.

Alice is now demanding that Jenny gives her half of the sum. Jenny has said no, and that she didn't agree to split the money. Alice is also demanding that Jenny puts the sum towards a holiday for them both. Jenny is offering to help Alice complete her claim form. I am offering to help Alice complete her claim form.

I think Alice is being rude and cannot believe she asked. Jenny is now considering giving her half to preserve their friendship. I think it sounds like bullying to me, and I think Alice should leave her alone and fill out her own claim.

Who is being unreasonable here.

She should wait to see what happens with her claim first and leave the other woman alone.

Alice couldn't be bothered! Which is extreme/ I'd be very bothered about getting some money, likely to be several thousands for Alice due to her injury.

I think Alice is embarassing herself

The money Jenny received is compensation for her - Jenny’s - injuries. Alice has no right, moral or otherwise, over it and she’s behaving completely unreasonably.

Alice is being a dick. The exact same thing happened with me and a friend. The friend couldn’t be bothered filling in the form - don’t think it would have crossed her mind to ask me for half of my compensation ?!

If she wants compensation she needs to claim her own. How bizarre.

However, if she's making her own claim, maybe Jenny can strike a deal that Alice's compensation is split both ways, too. She'd be quids in then.

Alice has got about 6 years from the accident date to put in her own claim for injury. She can deal directly with the other driver's insurance company and they can provide physio alongside any compensation, so long as they have accepted fault for the accident.
The only thing that makes it slightly more complicated is that her injury is an exacerbation of a pre-existing problem. The outcome she gets will depend on how much worse the accident has made her pre-existing problem.
But she does need to stop being an idiot to her friend who did bother to claim.

I was in that situation once as a passenger. I was off work for weeks with injuries. The driver begged me not to claim as it was his company car and it wouldn't look good on him as he'd just started a new job and got the car.


I divorced him a year later...!!


Bloody wish I'd claimed now...!

@mintymabel this is to reassure Jenny. I'm sure I'm right but she is doubting herself due to Alice's constant bringing it up

If Alice was that bothered she would claim herself.
The money is compensation for pain and suffering. Jenny's pain and suffering. She should tell Alice she has already spent it on cocktails.
