AIBU about my lodger

I’ve had a lodger for the last two years. Just before lockdown started she moved in with her boyfriend and gave me 4 weeks notice that she was officially moving out ( that’s what’s in her contract ).

So she stopped paying rent yesterday and was supposed to be here today to collect all her things. When she went to her boyfriends she left almost everything here - her bedroom is jam packed with all her clothes and make up, food in her kitchen cupboard and the fridge, bathroom full of her toiletries, jackets and shoes in the hall, plants in the living room etc etc .

She didn’t turn up. When I messaged her she replied that she can’t come to collect her things because of lockdown and she will come at another time when lockdown is over.

I pointed out that she is the one who has chosen to move out during lockdown. And she can’t just leave her stuff here, keep my house keys and pay no rent. And that moving your things out at the end of a tenancy is an essential journey, because she has no right to leave it here.

She has refused to come for it.

She says IABU because the new lodger doesn’t move in until June . But I was hoping to redecorate her room and buy some new furniture (because she has broken it ).

Besides I don’t think that’s really the point. It’s not my job to store her stuff for free.

AIBU?

What should I do ? How long should I give her to collect her belongings ?

It's not your job to store her stuff. Tell her new tenant is now coming in May and if it's not out by end of April you will place it all in driveway!

Put it in writing that you will take her to small claims for the rent if she doesn't move the items within 7 days x

She needs to collect her things. Could you make an agreement that you will stay away / remain in a different room so that she feels safe.

Not sure if you’re working (At work) but she could come then alternatively.

Tell her you will leave her belongings in front of the house/flat this weekend unless she comes and collects them beforehand...

Alternatively she pays rent for you to keep her things in her room ;)

In fact you can say this is the only way ...because you cant allow her to come in and contaminate your home now ....

Lets see what she will say ...

I would just put everything into black sacks OP ask for her new address and drop it at the front door!

There’s too much stuff just to put in a black bin bag. It’s probably enough to fill a small car. It’s everything she has minus a small bag she took to her Bfs.

I had arranged to go out when she was coming to get her things. She is refusing to come because it’s a non essential journey, according to her.

Moving is not a non essential journey. She is ‘allowed’ to get her stuff. I would give her an ultimatum date, after which her stuff is going on the street.

What is her proximity to you? If she's moved 100 miles away I might have a bit of sympathy and give a bit of slack. If it's other side of town, then she can her arse around tomorrow afternoon.

I have her new address but it’s about a two hour drive away. I know that’s why she’s not coming , because she CBA to do a 4 hour round trip. But that’s her problem not mine.

I would just let her know I am dumping it with the next garbage collection. She will know which day that is. Her loss.

She hardly sounds like the type to give a fuck. Leaving you high and dry to sort out the tenancy and bills.

You’re not the free Big Yellow Storage Company. Tell her you’ll be putting it out on the drive on x date and she needs to come and collect it before then. Cheeky bitch.

Box or bag it all up and tell her you will leave it all out in the front garden for collection on X date. Do this in writing via email or text and state in it that she is no longer paying rent, her notice period is up and you will not store her belongings. Make the email watertight.

Tell her to hire a man with a van and to arrange storage, and the man should come and collect it and take it all to the storage unit. That, or she turns up and gets it. I'm currently paying £300 per month for storage, so you could work out what the price of a unit would be, and charge her that. No pay up, no belongings returned.

So you don’t think I’m being unreasonable expecting her to collect it now?

It’s definitely not junk, it’s all her belongings, she will defo come for it at some point. It’s just that she thinks it’s ok to wait until the lockdown is lifted. I’m guessing that will be in late May sometime. Who knows ?

@Iflyaway it's not a completely stupid idea if I wanted someone's belongings gone out of my house then I would do it! It may be stupid to you but it's not to me... but OP I hear you 2hours away is a bit much!!

she is not a tenant she is a lodger rules are different that is the first thing.

regardless of lock down she still has to abide by this
send her recorded type letter with the above & give her 2 weeks notice to collect - this should cover you legally. I did this with evicted tenant ( we gave her several weeks & I had contacted housing officer at council directly to get her emergency accommodation which she got a few days before eviction was served)
