GDPR Photos Whats App

SO, yesterday i ran a local 10KM race sponsored by my client, at the start my HSSE manager asked to take a picture of myself , i declined stating he would put it on social media, at the end of the race i was having my photo taken by the official race photographer shaking hands with the race director ,
This morning in work i was shown a photo taken by the HSSE manager and shared on a group whats app ( which i am not part of ) Only last week we had VP HR in the office discussing GDPR and it was mentioned that you can only post photos of other people to social media with there permission, Whats app is classed as social media,
Thoughts !!

We're you in a public place ie a park or similar or in private land?
In a public place your "image" is still public. In your home, private garden, a school, which is not open to the public, then there are more privacy rules.

I hate it when a new law gets publicity and everyone thinks it can be used to solve the most mundane issues.

GDPR is set up to combat large scale misuses of data, not someone whatsapping a photo of you in a park.

If you don't want your photo online, why would you have one taken by the official photographer?

GDPR does not apply. However, you can ask, if as a courtesy, the photo could be deleted.

I don't think this is a GDPR issue, but it IS an issue. Your manager should have respected that you didn't want your photo shared around and they didn't and that is not okay. I'd have a quiet, serious word with them and hope they apologise.

Yes it was in a public area so yes anybody could have taken my photo and posted it online.
what annoyed me is that i said no earlier in the morning to having my photo taken, then for him to take a photo later and then share with colleagues,

I think you gave your consent when you were photographed at the end (unless it was a candid shot)

Photos taken at social or open events hosted by your employer would also be allowed as they are disseminating information of public interest.

I’m nit an expert though and you could consult HR. If you had said explicitly you didn’t want a picture on social media they should have listened to you. They could just say they didn’t know though.

It’s not nice of someone to share a photo of you when you declined a photograph previously but it’s nothing to do with data protection.
If you are really that bothered about it ask them to delete it.

It does if you are an international company , well thats what the VP HR stated .

GDPR has nothing to do with your photo being taken at a public event in a public park!

Why did your VP of HR not explain that GDPR is only relevant if your are working on something connected to the EU.

And its doesnt apply to photos taken in a public place?

GDPR is not applicable here, 1 you're in India, 2 you were in a public place.
However your boss was a dick to do that when you asked him not to.
