Gym posted photos of me on Facebook

I recently joined a small gym/training studio very local to me and I have 33 mutual Facebook friends with this gym as it's a smallish town and the PTs there are very involved in the local community, children's sport club said etc.

I had my first PT session today, purposely because I was advised it would be quiet and I was feeling very self conscious etc. It went really well and I booked and paid for my next session before leaving.

I've just logged onto Facebook and the first thing on my timeline is 4 photos by the gym page of me, mid session, red contorted face, dripping with sweat, one where my mum tum has escaped my leggings and looks to be flying off like a fleshy jelly spaceship! There are lots of comments, some just of people tagging their friends which I take as a pisstake, others along the lines of "any step is a step in the right direction".

I'm fucking mortified and fuming! I've messaged them asking them to remove them and had no reply

It's in the contract of the large national chain gym near me; unless you ask for it to be removed. The gym membership costs a little more if you do.

I hope they take them down fast though!

No I don't know how I didn't notice the pictures being taken! I didn't actually sign anything at all yet because I'm just doing pay as you go for the moment. Ugh!

That's really shitty- it would put me off using that gym tbh.
You can also report the pics to FB, they may be quicker at taking them down.

Oh my god. Make a massive complaint about it. You might get a free PT session or something. That is so intrusive and horrible posting unflattering pictures like that. I thought they had to ask first and then get your consent to use that particular photo. Maybe report the facebook post as well and write a comment on their wall e.g. 'Can you please reply to my email/message regarding posting pictures of me without my consent'. I would be furious.

That's outrageous. If local mums knew that they would be photographed like this mid session without permission, it would ruin their business.

I think they should have got a model licence. Take a screenshot of it and go in and talk to the manager. Point out that they didn't get a model permission and they've breached your privacy. If your home insurance comes with free legal advice you could even go to them.

That's terrible. Why should I have to pay more just because I don't want to be publicly humiliated? Which chain is this?

PS - the manager may not even know about this. It could be a junior social media manager unaware of the obligations to get permissions from models used in their business promotion.

I'd have thought they'd have to get your permission for that? You usually have to sign forms to allow consent for social media with businesses/courses/schools etc. Check your gym contract.
Oh, and complain and make it clear you definitely don't want your photo taken!

WTAF?! Really? Angry That's disgusting if so! You can't penalise people for not wanting themselves plastered on social media and charge them if they say no!

Could there be a data protection issue here? Although OP hasn't been named, anyone who knows her and sees it will know which gym she belongs to.

Yes, that's a good point. Report it to Facebook. There's an option under the report it facility.
Click on report. Then "It shouldn't be on Facebook."
Then there'll be an option asking why - I think it's something like "this photo is of me and I don't give permission". Click on that.

Can you phone them to get it sorted ASAP? I'm a regular gym user and active on social media and I'd be furious about this. I'm furious on your behalf! I wouldn't be going back.

PPS - I have no real knowledge of this and when model release forms are needed - perhaps double check everything with a reputable photographer or someone with legal knowledge in this area.
