DS came home and said Daddy smacked him

I am so cross. DS is nearly 4. He is not a naughty boy although he has his moments like all children! I left exh 3.5 years ago due to emotional abuse and some physical including him strangling me. We are currently in court since last Oct - he wants joint custody, I don't think overnight contact is safe until he has demonstrated commitment to managing his abusive behaviours around dS. Court has been really supportive of me putting boundaries in place - given me a non mol order to stop he constant texts, he doesn't do collection or pick ups, he has a very clear contact schedule of 5 hours on a Saturday and threat of jail if not returned (after refusing him to give him back) Anyway. Things were ok but recently have been escalating again. Last week DS came back upset because Daddy had been shouting, this time says Daddy smacked his bottom because he was being naughty. I am so cross. I'm worried I'm overreacting because of all the back story. But he's tiny! People don't smack their children anymore do they?! My son idolises his dad, and he can't even fucking control himself for 5 hours per week! And he wants joint custody!!! What should I do? We have a contact book that goes with DS that I normally write in with any concerns, but I don't want to wait until next week! I could ask my solicitor to write to him... but should I be reporting this anywhere or is that massive overkill? There's no mark. Totally prepared to be told I'm totally overreacting... as you can tell there's a huge backstory!
