TRying to sell the house with tenants in - undisclosed dog

So had a viewing at the house yesterday and the patio was covered in dog shit, as was the garden. I figured it would take a few months to sell so was happy for them to stay whilst it was on the market. Am now starting to think this is going to be impossible isn't it ?
Can I afl them to remove the dog for the rest of the tenancy ?

If the tenancy agreement you have states 'no pets', then yes you are within your rights. Otherwise could be a problem for you.

Is the tennancy agreement no pets? If so of course you can. It would be much easier to sell without them there at all tbh.

There's never been any mention of pets, doesn't say none but surely they have to disclose they have one ?

No. If the agreement doesn't specifically say "No pets" then they don't have to disclose a pet.

You can ask them to clean the patio area up. But if the house is going to sell, it's going to sell with or without a dog in it.

If you're selling their home they're unlikely to do you any favours, especially as they are already allowing viewings.

I'd find it very difficult if I was asked to re-home the family pets so I'd expect your tenants to resist any such suggestion. As a compromise, could you get them to agree that they will be scrupulous in clearing up after the dog as an alternative to you terminating their tenancy?

They don't have to sell it, they could send it to friends or family. They are fucked anyway to be honest, they've gone bankrupt so they'll find it difficult getting another tenancy even without a dog

Surely they can live how they like, as long as not leaving long term damage (poo can be cleared and presumably they'll clean before they leave). And if they do, that comes out of the deposit.

We rent and are clean and tidy, but I wouldn't be happy if LL was selling and dictated how we kept the house, whilst we are paying good money to live here!

Navy Oh yes it IS their home. It's not their HOUSE but it is their home.

Glorious. OP cannot terminate, she's not within her rights to. She can give notice.

OP...if they're bankrupt and in financial difficulty be prepared for a long wait to get them out. They will need to wait until you've got them out via courts probably which can take months after the offical notice period ends.

They will have to do this to ensure they get help to be housed.

Of course it's their home. That's what they pay rent for. They have a right to quiet enjoyment of their home, so don't need to let the landlord do viewings at all.
Even if the landlord terminates the tenancy, they could refuse to leave at the end of the notice period and wait to be taken to court. It's in the OP's best interests to keep the tenants on side.

Newbrummie I fear it is you who are fucked. You have tenants in who are bankrupt. You can serve them a section 21 notice but be prepared for them to stop paying rent and to have to take them to court to evict them. You can't possibly sell your house while this is going on.

If you can afford it I would look at giving them notice. They have a date to organise themselves then and if necessary you can clean up when the house is empty.

Unless you're selling it as a buy to let with tenants?

If they won't easily get another private tenancy then they will almost certainly be advised to stay in the property until they are physically evicted. Dog poo is the least of your worries.

Yes it is. Are you saying that everyone living in rented has no home? Don't be ridiculous. They have not breached their tenancy. It maybe the landlord's property but it is the tenant's home.

Dogs do crap in the garden. They need to go at midnight - you let them in the garden. "crap all over the garden" means different things to different people. It could simply be that there are 3 lots in the garden in different places and the tenants have not had chance to clear it yet. They may be a little busy looking for somewhere else to live.

OP - If I were you, I would think carefully about what you do here and how you approach it. If my landlord told me I could stay if I got rid of my dog, I'd tell him where to go and tell him he better serve me notice and start looking for another property. I'd also refuse any more viewings until I had moved out. A dog is part of the family and not easily gotten rid of, especially for the person who is throwing them out.

Merlin40 - dog shit all over the garden can't be good for their kids tbh.
If they stop paying rent they will be out damned quick and they know it, not likely to make their kids homeless with no way of being housed by the council for intentionally making themselves homeless and their parents as guarantors.
