But it isn't mine!

Definitely more of a WWYD.

My exh is planning to take me to court for having a Facebook name using his surname. I live in France and I do not have the right to use his surname since the divorce and never have. Been divorced for nearly 9 years.

But, it's not my page. It belongs to an American lady which a cursory glance shows. It's clearly not mine. Not entirely sure how to tackle this.

Please can someone let me know what they would do. I am secretly delighted that he googles my old married name after all these years.

He is not a nice person. EA DV massively controlling etc.

I wouldn't do anything. If it's clearly not you then you have nothing to worry about and he can't do anything about it.

Let him. Then show them

He'll rack up some nice costs!

StealthPolarBear Thu 10-Nov-16 08:34:48

My first reaction would be let him! Presumably you can just reiterate this is NOT YOUR PROBLEM.
However you migut want to take advice from more sensible people.

Scarydinosaurs Thu 10-Nov-16 08:35:34

Email his solicitor and say you can confirm that the page is not attached it anyway to you.

What a twat to pursue you for this!

PurpleWithRed Thu 10-Nov-16 08:35:55

I would let him waste his money on solicitors, he's obviously a stupid git. There is nothing you can do as far as I can see.

TupsNSups Thu 10-Nov-16 08:35:56

I wouldn't do anything, if he takes you to court ( which I presume he will have to pay for) and it is proven it is not you he is going to be out of pocket and also look like a complete bellend. Just ignore.

Sundance01 Thu 10-Nov-16 08:36:21

I agree - do not give him the satisfaction of reacting.

If you are not doing this you have nothing to worry about.

Wallywobbles Thu 10-Nov-16 08:36:24

I probably will be sensible but when I opened the registered letter yesterday I was bricking it. He really is a total bastard. But when I saw what it was about I laughed.

TupsNSups Thu 10-Nov-16 08:37:18

How do you know he is planning legal proceedings?

TupsNSups Thu 10-Nov-16 08:37:45

X post sorry.

Wallywobbles Thu 10-Nov-16 08:39:47

Because he wrote and told me about 6 months ago. Telling me to warn my lawyer. He has a history of self presenting in court. He is a vexatious litigant - with a history of loosing. My lawyer loves winding him up and letting him loose.

Nicketynac Thu 10-Nov-16 08:40:12

As an aside, why could you not use his surname? Surely you can have whatever name you want?

Penfold007 Thu 10-Nov-16 08:40:26

I'd gather as much evidence as I could such as printing out some pages from this woman's Facebook page especially anything suggesting she lives in the USA but other than that I would react.

GetOutMyCar Thu 10-Nov-16 08:41:04

Even if it was you, what's he taking you to court for anyway? You can use whatever name you like can't you?

I'd completely ignore him and let him waste his money.

Arfarfanarf Thu 10-Nov-16 08:41:07

I'd also just let him crack on.
He's going to look very stupid.

Wallywobbles Thu 10-Nov-16 08:41:51

NOT in France. Your surname belongs to your husband. You can keep the use of it for your marriage. You can request to keep it at divorce but the man can refuse. It'd work the other way round of the man took the woman's name.

Also nigh on impossible to change your name here.

ChuckGravestones Thu 10-Nov-16 08:41:54

Let him crack on. Fucknugget.

Cel982 Thu 10-Nov-16 08:42:36

Let him at it. If it gets to court it'll be thrown out and he'll be liable for costs, presumably. He sounds unhinged.

Wallywobbles Thu 10-Nov-16 08:42:44

Fuchnugget sums him up perfectly.

blueskyinmarch Thu 10-Nov-16 08:43:24

I can't even begin to think how it is illegal to use whatever name you want as your Facebook name. I would just let him get on with it. It will be to his cost when he finds out it has no link to you at all.

OohMavis Thu 10-Nov-16 08:44:58

Goodness me he sounds like a genius hmm grin

HazelBite Thu 10-Nov-16 08:45:22

Wait for him to spend money on Solicitors and if he does issue proceedings then contact his solicitor saying you won't be attending court as it is nonsense.
If he persists or doesn't instruct solicitors and he still issues proceedings just send irrefutable (ie paper) proof that it is not you to the court and explain in the circumstances and that you are not attending, well in advance of any arranged hearing.
Would he be issuing proceedings in a UK Court.
Personally I think it is a lot of hot air, but you know him best and know what he is capable of.

Wallywobbles Thu 10-Nov-16 08:45:33

He is pretty mad. He is NC with his whole family his choice and theirs. An alcoholic albeit a day time functioning one. And definitely narcissistic. I thought he had some kind of MH issues but when I read Why Does He Do That, I came to the conclusion he is just a really nasty person.

DoYouRememberJustinBobby Thu 10-Nov-16 08:46:52

Christ on a bike is he for real?
Make sure you take a few screen shots of that woman's account if possible just incase he goes balls deep into crazy and sets something up.
