To expect compensation for this?

Long story short, I bought an automatic car 2 months ago from a well known national car dealership. It's second hand, but only a 12 plate with 24k on the clock. 4 weeks ago the car has a transmission failure. The same thing happened again a week later, and has been with the dealership since. The issue is so catastrophic that they are having to fly In a specialist to fix the issue, so it won't be fixed until Friday. I will have been without a car for 3 weeks by that point. The dealership have offered to pay for my busses until it's fixed, and are obviously paying for the cost for it to be repaired. It has been a very stressful time as I have had to fight for them to pay for it. A friend of mine thinks that I should ask for monetary compensation from the dealership for selling me a dud car in the first place, making me car-less for 3 weeks, and all the stress and worry it has caused. The people I have delt with have been very professional so far. Aibu to pursue compensation from them?

I'd ask for my money back and buy another. Isn't that possible?

If not, the least I'd want is free car hire.

I don't think that'll fly. You're unlikely to get compensation from them. They're repairing the car and offered you reimbursement for taking public transport. It's odd that they don't have a courtesy car you can borrow.

You'd be better off asking for your money back on the car and getting something else, if you still don't know when / if it'll be done.

If you got it in HP, speak to your finance company who will liaise with the garage.

DH had to do this for a bad car and got his money back plus compensation for any losses occurred.

What warranty did they give you?

I would have expected a courtesy car. If it were me, suggesting I get the bus would be a none starter.

The OPs car was an automatic. Very few dealers hold automatic courtesy cars. Some don't even hold automatic demo cars (hello ! Ford !).

Ditto on expecting a car hire, not just bus ticket refunds. Is there scope for saying "screw you" and buying a different car having got all your money back? They don't sound like an ideal place to be dealing with.

not compensation, but they should have provided a courtesy car.

As it went wrong so quickly I would be formally rejecting the car & asking for a full refund. I think you can still do that despite accepting their offer to repair.

Thank you. They did offer me a car but I would have to pay £12 a day for the Privilege. After getting an earful from dp, they offered to pay half. I still think that's outrageous, so theyre putting £6 a day for my bus fair. According to them I can't return the car as I already agreed to a repair. That's because they were denying there was a fault with the car before purchase, and as far as they are concerned they were carrying out this repair for 'goodwill' until they got into the car and realised they could no longer deny that the fault was there before purchase.

I think they're wrong

  1. If a buyer rejects a car between 30 days and six months after ONE repair doesn’t fix the problem, then in theory the buyer is entitled to a refund (see 7 below).
  2. However, if you are entitled to a refund, the dealer is entitled to charge you for reasonable use of the car whilst you had this, to be offset against any damages you can demonstrate. But there are no guidelines as yet, to suggest what sort of costs would be involved here.

  1. The presumption of the Act is that if something goes wrong with a car during the first six months of ownership, it’s fair to assume it was there at the time of delivery…

That's ridiculous - you are already paying for a car that doesn't work! You shouldn't have to pay any of the courtesy car cost. Unbelievable, no wonder dealerships have such a bad reputation.

Do you still want the car?

£12 a day, sounds familiar.... sounds a lot like AC?

If so, they tried that with us, they can (and did) waive the charge. Our very long story ended when we rejected the car 2 months later and received a full refund.
Personally I'd try and reject.
