so in my consent order it is drafted that my ex pays 40% of the mortgage and i pay 60%, the house is on the market and i am living in it and dealing with viewings repairs etc.

i have told my ex the house insurance cost (buildings only as i will pay content) with the expectation he pays 40% to protect his investment (its only £40 so more of the principle for me) he tells me he has gone to a solicitor and as it isnt worded in the consent order he shouldnt have to pay it.

is this right??

also i dont believe he has gone to a solicitor for the sake of £40.

i havent replied to him as i am not rising to it but it has made me cross.

Well, it should have been clearly laid out in the consent order so it was very clear what he was liable for. If it isn't, even though it seems obvious you would need buildings insurance if you have a mortgaged property, I can't see how you would force him to pay.

respond you shouldn't have to pay it and neither should i shall we drop the buildings insurance altogether or act like adults

i dont want to force him to pay, its only £40 so not worth a row, he had a really shit solicitor who kept making mistakes on the consent order, my solicitor amended the consent order then his solicitor changed it back (terrible spelling mistakes etc), it covered the most important things and i desperately wanted to divorce him without any extra costs incurred.

im just disappointed really as i thought our communication was improving then he pulls a stunt like this. i have been so laid back and easy going it just pisses me off.
