AIBU?

To refuse to pay this private parking ticket

Was slapped with a ninety pound fine for parking without a ticket. Could only see one parking ticket machine and it was out of order with a mellow jacket on. Sobi just didn't pay.

Apparently there was another one around the corner. It didn't say this on the others jacket

Also the fine its too high IMO, its 2 pounds to park for the whole day. So mayabe I deserve a 2 pounds fine plus a ten pounds admin fee. They wouldn't of lost out on ninety pounds for the two three hours I was there for .

As well as wearing a mellow jacket was it smoking a cigar?

The Supreme Court recently ruled on the validity of such private tickets and a £85 penalty was upheld. So you're unlikely to get very far in the amount itself. What may be more open to debate is if you reasonably believed there was no way to pay the charge and thus didn't.

Get a photo if you can. Dispute, dispute dispute. You'll be too much of a bother for them to worry about.

And to the asshole parking companies who have google-alerted this thread and are reading this right now - here is my message to you:

"Why don't you let shoppers park and spend money to get the economy going instead of imposing trite little fines and being anti-commerce. You don't produce anything or add to society - just stop. Get another job. Add to life. And also, finally, please fuck off". Thank you. Flowers

Do contact them to negotiate the fine level...

Either ignore it entirely or appeal on the grounds that it was not possible to make a payment.

If possible, obtain photographic evidence of the out of order machine.

A hello jacket is a sexy jacket, like the hello boys wonderbra ad.

They won't negotiate on the charge, though. Either they will rescind it entirely or you will be expected to pay. They are legally able to charge up to, the last I checked, £100 to cover their loss.

Unfortunately the fact that you didn't see the working machine isn't a valid reason not to pay, didn't you look and see if other cars had tickets? Ignoring it is probably not a good idea after that supreme court judgement last week.

You don't have to pay a private parking ticket, only a council one.

Just ignore it. Ignore again when they write to you 1 2 3 4 5 6 7 times....

Then ignore again when they threaten to take you to court 1 2 3 4 5 6 times ....

Ignore, ignore, ignore, as if you lived on Mars.

..... and lo, it shall pass...

Sadly that's no longer true OhBeloved. It used to be correct, but the law changed so they could end up in hot water ignoring it.

Appeal, and try Pepipoo for help.

Not any more OhBeloved, the supreme court found in favour of the parking companies in this matter last week. They can take you to court and they now have a legal precedent in their favour.

Report
witsender · 14/11/2015 16:47

Don't just ignore. They can, and will chase you all the way to court. Appeal, and if that fails, pay.

I think you should have made more effort to find a working ticket machine. If as you say there was one around the corner, but you didn't use it, then I'm sorry but you deserve the fine.

I think many people wouldn't pay. Its not a legal thing and as long as it's not council, they apparently can't do anything. I've been caught twice and tried to dispute but did end up paying (too much of a wuss not too!! Haha ) I have friends who never pay them!

Report
WhoKnowsWhereTheTimeG0es · 14/11/2015 17:07

That has now changed Rpj, the supreme court has ruled that these charges are valid.

Rpj16 · 14/11/2015 17:22

Oh dear.. I suppose OP should just pay it. Hopefully the small print says 50% off if paid within 2 weeks.

Vagabond, if the owners of car parks didn't enforce parking restrictions people would park there all day while they commute to work. That would leave no spaces for genuine shoppers. Do you really want to achieve that?

And no, I don't work for a car parking company.

Report
DifferentCats · 14/11/2015 18:46

The charges were valid before the supreme court hearing. They were always able to take you to court. It's a question of whether they will.

They make their money by people paying up first time. Not by chasing them over and over again and starting court proceedings that they might not win.
