Thinking my builder is to sort this out...

Getting extension done. Builder has been doing well so far. We have been getting new bathroom cabinets installed. We got them delivered to the house (we are not living there whilst work is going on). He said he would check them over and let us know if there were any probs. he never let us know about any probs. we were round at the house a few days later and noticed the cabinets were installed. I was looking at the and noticed they were damaged in places.

I raised this with him, over email the same day. 2 weeks later he has come back saying they arrived like that so I will need to raise it with the supplier. We had been emailing about other details over those two weeks, but only after several reminders did eh comment on the cabinets.

He is taking the piss surely. He decided to install damaged cabinets. To me the responsibility lies with him to sort this out. AIBU?

I'm not sure he can sort it out if he didn't order them, but I agree he was remiss in installing them without checking.

Sorry, I should have said that I don't expect him to try and get the supplier to replace them. The return period for damaged goods is 7 days. He installed them I the day they delivered. But ever told us that they were damaged upon arrival. No supplier is going to take back goods in this situation. I expect him to get me a new cabinet to be honest!

Legally you have longer than 7 days to return faulty/damaged goods but it may be harder to prove that they were like that on arrival now he has installed them . If he has a lot more to do is it worth potentially losing him ? Maybe leave it for snagging.

If your agreement is that you are supplying the materials then sorting out any problems with them would be your responsibility - H puts a markup on materials he supplies to allow for this kind of thing.

Did the builder admit he knew they are damaged if so he WAS in the wrong for fitting damaged products.

He knew they were damaged but went ahead and installed them. The plumber has back this up. Seems stupid to me!

He is blatantly an idiot (h would have told you and not installed them) what did he think you would want him to do...he has wasted your time and his.

Now they have been installed he has made it more difficult for you to get a refund/replacement. Id say he is responsible for removing and refitting and, cost of replacement if your original supplier is unhelpful.

You can always contact trading standards if he is not obliging - but please give him the chance to put it right first Smile
