Neighbour's tree - update

If you read my original thread about my neighbour's unreasonable demands in a not like for like replacement of a Hawthorn tree in a shared hedge, there is an update.

I have paid for the replacement with a different larger tree in a different spot. However, it has made me feel so different about living here. They are new neighbours so I haven't felt this way before.

Our very large garden is L shaped. The bottom of the L adjoins their garden and the bottom of the L runs along the bottom of other neighbours' gardens. That part of the garden is about 0.2 acres square. It has access of 4 metres wide to a main road and is in an allowed development area within our village. When we purchased the house 5 years ago we were told that it was prime development. We didn't develop it as we wanted to stay in our home and wanted a huge garden.

We are now working with an architect to put plans together for 2 or possibly 3 detached 3/4 bed houses. We live an hours commute from the City of London and the land would be worth over £300k. It would clear our mortgage and would still leave our home with a large garden so would not reduce our house value much at all.

We could then sell up, have a bigger house with half the mortage. No brainer really.

Silly neighbours have forced our hand.

It's sad you cant enjoy your garden, but I'd love to see their faces about the houses. Will you need to get planning permission or has it already been granted?

Yes we will need planning permission. We are in the Weald. However, the South East is desparate for new houses and our parish council need to build a certain % each year.

The area at the bottom of our garden will have a number of neighbours complaining. However, it doesn't block out light from their houses but it will spoil their view. However, nobody has a right to a view.

I don't feel great about pissing people off, but our mortgage is £280k. We have young children and can't afford holidays etc. We could have a bigger house plus a mortgage of around £100k. This would take so much pressure off us as a family.

We loved it here so much that we weren't going to build. However, I don't want to have years of them growling over the hedge (now with no Hawthorn).

Oh, I do love a good righteous schadenfreude moment.

They are going to object their arses off about it, but I doubt that will make a blind bit of difference to the planning dept. Good luck!

We will get planning permission because the land will be worth far more. Also we will stay here till the houses are built as we are unlikely to sell our home with uncertainty so it will be better to sell after the houses are built. Our garden will still be over 100 foot long and about 100 foot wide. We will plant laurels and a large fence at the bottom of the garden so that our outlook, whilst will have the top/side of houses, it won't be too bad.

Our house is currently worth about £570k. I think it will be worth about £550k. But with the land being over £300k, it is a no lose situation.

We do think we will get planning permission but don't think we will get it straight away as we will get people complaining. However, they don't have a legal right of complaint.
