AIBU?

to think I have been ripped off by this shop today?

Last week I went into a local shop which is part of a small chain of shops and saw a jacket I liked but they didnt have it in the size/colour combination I wanted. They were keen to "get one in for me" so I said yes and was a bit surprised to be asked to pay for it. When I was hesitant, they said it was ok, if I didnt want it when I tried it on when picking it up I could get my money back.

I called into pick it up today. I saw that all these jackets were now in the sale with 15% off. When I pointed this out they said oh yes, but not in this colour.Hmm I said I was surprised by this as had looked on the company website and had seen that my colour was actually last season's. I was assured they were continuing the colour into this season as it was "so popular".

I left with the jacket and I have just had a look on their website and guess what - my colour IS in the sale. I feel totally ripped off.

Go back and ask for a manager. Or the franchise owner. Don't put up with it.

claudedebussy · 22/02/2013 20:51

i would return the jacket.

babiesinslingsgetcoveredinfood · 22/02/2013 20:51

Go back

sooperdooper · 22/02/2013 20:53

I agree, go back tomorrow and complain, I'd just ask for my money back

SpringyReframed · 22/02/2013 20:55

I really want my money back. I dont even want the bloody thing now. Would I be entitled to a full refund in these circumstances? Not sure on the consumer rights on this.

Did you pay by credit card? If so call your provider and open a merchant dispute.

claudedebussy · 22/02/2013 20:56

i think you're entitled to a refund, just on the principle. go back and ask to speak to the manager.

SpringyReframed · 22/02/2013 20:57

Funnily enough I did use a credit card and I wouldnt usually for this sort of purchase.

I'd have asked them to scan it and see what it came up on the till as.

NamelessHereForEvermore · 22/02/2013 21:46

How much is the price difference? Is it possible someone has trousered the difference?

BamBamAndPebbles · 22/02/2013 21:50

I work for an international retail company. Our website isn't run by the uk part of the company, but our ho in another country.

So our prices on line can be different in store.

And one style in a different colour may be a different price. One will sell better than another so it won't be reduced as much.

But if you're not happy(understandably) take the jacket back for a refund and buy it online if the manager can't match the price online.

BamBamAndPebbles · 22/02/2013 21:52

Also if you bought it full price you're much more likely to be able to get a refund.

If was bought at a reduced price, you may not be entitled to a refund.

DinglebertWangledack · 22/02/2013 21:52

Take it back and if you can a printoff of the page with the jacket, at the reduced price. See what they say.

SpringyReframed · 22/02/2013 22:00

I dont think anyone could have trousered the difference because I used a credit card.

I think what happened was they knew they were going into reduced and wanted my money early so they could get full price off me. I understand about different stock being reduced differently but it seems too much of a co-incidence that the only full priced jacket was mine. All colours in the shop and on line reduced. The shop didnt have any other jacket in my colour (or so they claimed.)

Do you think I should ask for a refund and not say anything until I have secured it or go into the shop all guns blazing? Not sure how to approach it. Dreading the "you can only have a credit note" scenario.

As bambam said, websites can be run on a different system, the shop staff may have to go by the price the till gives them. Contact the website or HO and ask.

SpringyReframed · 22/02/2013 22:11

foxache, because I had already pre paid for this item, she didnt run it through the till. It was just handed over to me.

BamBamAndPebbles · 22/02/2013 22:15

So when you bought it, it was full price but you suspect by the time you collected it had been reduced in the sale?

If that's the case, try haven't ripped you off in any way at all. Just bad luck.

Phone the store and ask if its been reduced in the sale.

You should be able to get a refund I would have thought. Whether they will let you buy it back immediately is a different matter. You may have to buy online if they won't let you do this.

foxache · 22/02/2013 22:18

I worked for a small chain and I guess I'm projecting your situation as if it's that shop. We received items for customers bought online and had to say it was separate.

A pre paid item bought from a different system will have been really complicated to refund and resell, the item might not have been on their system. Still, they could have explained better and tried to help. I don't think you've been ripped off, just fobbed off IMO.

SpringyReframed · 22/02/2013 22:41

No, my purchase had nothing to do with "online". They just said we can get one in for you. I said yes, and then they wanted me to pay. "we usually request payment". I was an idiot. If I had refused they would have no doubt got it in anyway and I would have paid for it today and it would have gone through the till properly.

Am I within my rights to get a full refund? That's all I want now.

Just have to check your receipt.

No company is obliged to refund unless it faulty.

Most do refund though. Which store was it?
Hope they help you when you go back.

AnyoneforTurps · 22/02/2013 22:50

Really annoying (I'd be fuming) but I don't think they have actually ripped you off and you are only entitled to a refund if their normal returns policy would entitle you to one.

You ordered the jacket at the full price so the 15% reduction was did not affect your original decision to purchase (legal term = of the essence to the decision). Nor was the shop advertising the jacket in your colour as being available in that store at the reduced price - stores are quite entitled to sell the same item at different prices in different stops or online.

foxache · 22/02/2013 22:58

It does sound like they wanted the full price from you, it's odd to pay in advance, in my experience anyway.

If HO is open tomorrow you could ask for your discount, otherwise I don't see why you couldn't get a refund. They said initially you could get your money back if you didn't like it.

I think it might be breach of contract - found a thread on money saver for you.

forums.digitalspy.co.uk/showthread.php?t=927810

The real question was was it on sale online when they ordered it in for you?

knackeredmother · 23/02/2013 08:59

Good luck, let us know how you get on!
