To be so fed up with this parked car?

This car turned up in the layby outside our house absolutely months ago. It hasn't moved an inch and my neighbours began asking about it. I happened to see a girl outside near it as I left one day so asked her if it was hers. She said yes and she was selling it. As far as I can see nobody has been anywhere near it and it still sits there. I see this girl regularly as her kids walk to the same school as my kids. They live down on the main road. I don't know why she can't park it outside her house with her other car. There's no restrictions or yellow lines or anything.

Anyway, the council came round asking about it. Someone's reported it as being dumped. I saw her again on the school run this morning and politely asked her if she was going to move it as people were starting to ask. She started to say that she would be using it instead of her own car, then she said someone was coming to look at it (again) and then she finished off by telling me that it wasn't my road and it's just a car and that she can leave it outside my house if she wants to, it's not my driveway.

Now am I being unreasonable or is she? My road is not some public scrapyard. We get enough people using our layby to turn their cars round in without dumping them there as well. When they can't turn round because there are cars parked there they turn round in my driveway. I know it's not the end of the world but its been going on for months and its just bloody annoying now!

I'd ring the council again and report it as dumped. But then again I am in a grumpy mood this morning and next door keep parking their van across our gate.

Report as abandoned and then someone can deal with the problem.

I think I read on here that if it's been there for 3 or 4 months then it can be towed away as an abandoned vehicle.

I suppose it depends on what the layby is for. Is it just for residents use? Or just general public parking? If the car is taxed then it has every right to be on a public road. I wonder if she is trying to get it stolen? Is it left unlocked?

If it's taxed and there's no restriction on parking (as there often is in a layby?), she's got perfect right to leave it there and it would be really dishonest of you to pretend it had been dumped if she's clearly keeping an eye on it.

Not everyone drives a car often, you know - 3-4 months is a really long time given she could get the tax back if she just sold it, but she may have her reasons.

Jeez no wonder the Council are too busy to come out to genuine people when they're being led a merry dance by people in grouchy moods.

I'm sure if they've been out already, they'll have got on to the DVLA and asked them to check with the owner.

She's legally entitled to leave it there if its taxed. I know its very annoying when someone leaves a car permanently parked outside your house and some people can be very cheeky in this regard.
But it is equally cheeky to demand that someone moves their car from a public road just because you don't want it there.

Someone dumped a car outside our house for weeks. The alarm started going off regularly until the battery went flat - fortunately I was on holiday. DH phoned the police several times and eventually they contacted the owner who lived bloody miles away. It was parked close to a bus stop and a junction so I think that is why the police got involved.

OP - you refer to the layby as yours. Is it? Otherwise she is probably not doing anything wrong, but it would annoy me as well.

If it is taxed then she is within her right to park it wherever she likes as long as she isn't breaking any traffic laws.

If its taxed and insured she can park it where she likes, so long as not violating traffic laws....

and even if she was violating traffic laws that her choice / perrogative, and between her and the traffic wardens / police etc etc (not you)

I remember I used to live in an area with an abysmal bus service so I had to drive down to the next suburb and park there to catch a bus to work. I rarely parked outside anyone's house but one morning I had to do so as there was no space in the local car park. This woman came out of the house and started shouting at me that I couldn't leave the car there (public road, no double yellows, not blocking her drive) and a neighbour backed her up. I was so hassled I just got in and moved somewhere else, but often wished afterwards I'd just ignored the pair of bullies.
I think people have got incredibly self entitled about the road outside their house. Yes, it is annoying when cars are always parked there. But there's a big difference between feeling a bit irritated and actually insisting the car be moved.

Yes it's taxed. Runs out at the end of this month.

When I say 'our' layby I mean its just a pull-in for me and my neighbours outside our house. The only other people who use it are people turning their cars round. It's a cul-de-sac. Nobody else uses our road, it doesn't go anywhere.

I think the general consensus though is that she's being cheeky, and that's good enough for me. I don't feel quite so unreasonable now.

Just hope I don't bump into her again today. I'm a wuss, I hate confrontation of any kind.

If it's taxed then she's well within her rights to park it there. Did she say why she hasn't parked it outside her own house?

Not sure there is a general consensus that she is BU - unless you are only reading the posts that agree with you.

If she has paid road tax she is allowed to park on the public road (unless there are parking restrictions). If it was a private road it is a different matter, but just because it is outside your house doesn't make it yours. Hence it being a public road.

To report it as abandoned when you you know it is not would be immoral.

Actually, it's not necessarily true that you can park like this to sell a car.

Some areas have a by-law which prevents cars being sold from the roadside for this very reason.

Here's an example. This will be why the council has got involved.
