can I get arrested

My 15yrold son has turnt out to be a little shit he does drugs bring people into my house late at night and has treated his gf disgusting.

Tonight I told him I wish I never had him and kicked him out my house. My friend said I can get arrested for kickin him out is this true?

I have to assume so. He is 15, after all. He is your responsibility.

Only if you physically kicked him, that would be assault.

Chucking him out, no you wont get arrested.

No idea but I think being arrested is the least of your worries...have you thought of family therapy or something?

I think you would be in more trouble for drugs on the premises if he does them at home.

Has he got somewhere to go?

A person with Parental Responsibility for a child has the legal duty to protect, house and provide for them until they are 18 (or 16 if they marry). So theoretically you could be prosecuted.

Doing and dealing are different. Rarely get arrested for personal use amounts.

Why don;t you do what all my sons friends parents do? call the police and have him arrested, they get a week in care and come home with a new wardrobe of clothes and an Xbox

Is this completely a done no going back deal? I wouldnt be worrying about being arrested, you have much bigger problems here. What outside services have you got involved? What about his school? Do you have the youth offending team involved?

Call the police and tell them why you threw your son out. That way if they find him they will call social services, and no, you don't have to take him back if he is doing drugs and you have no control over him.

Do you know where your son has gone? If he is picked up by the Police they might bring him straight back to you, and ask you where you thought he was.

Can you arrange for some help and support, from other family members? Do you need some advice on where to go from here?

It would have been better to contact social services and have them help you. If you really won't have him in the house, they could have found him somewhere to stay.

My god though, to tell your child that you wish you'd never had them Sad I cannot imagine the state things must be in that those words came out of your mouth, it's hard to imagine ever getting to the point where you could say that to your child. the situation must be horrendous to have seen you get to that point. I'm really sorry. Both for your son to hear those painful words and for you to have got to the point where you snapped and said it. The saddest thing, is that what is said can never be unsaid. It's just so awful for you both, I'm really sorry.

You really need to find out where he is and make sure he has somewhere to be, this may involve an emergency call to social services, telling them you're in crisis.

At the end of the day, he is a fifteen year old child and shutting the door on him is not an option. You have to hand him over to someone.

Horrible as this situation is, it has the potential to be a turning point. with the right intervention, he could use this horrible experience to turn things around.

My step-Dads ex-wife has kicked her son out on numerous occasions, but she has never been arrested.
Mind you this could be because no-one ever reported her, and his Dad then homed in then so he was never homeless. If your son has no where else to go then it may be different as his parents have a duty to house him.

I agree with mellow family therapy sounds like a good idea.

I frequently have a sofa full of 15-17yos that have been slung out. last year I had a whole summer holiday worth of them, festering and smelling rank.

there are time I wish I could go into care to get away from the dysfunctional peripherals of my life

You should contact social services and tell them that your ds is beyond your control,tell them about the drugs and that you need him to live elsewhere-then you will have acted responsibly.I am quite shocked that your concern is for yourself and not for your child.

I cant have him in my house no more hes not my boy no more he gets in my face he beat up his gf and he brings all sorts into my house even when im asleep

Where does he get the money to buy that stuff?

If he is stealing to fund it - report him. perhaps police intervention is also needed.

You wont be arrested.
If you really cannot have him in the house you can contact social services and he and you can asked for him to be accomadated under s.20.
They may well resist as its hard to place stroppy 15 year olds but its better than him being on the streets.

You dont want drugs in your home because of the violence that follows them.

Are you really at the end of your relationship with him? Is there any hope that you can work this through.

Do you have younger children at home?

Phone the police and tell them what he has done and that you threw him out. That way they will look for him and take him somewhere safe.
