Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

Myself and all my colleagues received our P45 when the payroll provider was changed.
It coincided with lockdown and there was frantic chat on our WhatsApp group before HR put out an email.
They were as shocked as us Grin

Hope it us something similarly daft in your case.
Ring your boss, see what he has to say.

Are you still on maternity? If you are you are in a protected category and.thry can't just sack you. Even if you weren't on maternity im sure you.need to go through the warning procedure for sacking, even immediate sacking needs some sort of investigation. If you were made redundant you will need to have had notice. Ring acas for advice and look at a solicitor specialising in work place. Are you with a union? If so contact them,

I’ve just double checked with a colleague and no payroll changes, and I’ve sent an email to my boss and HR. Fucking well confused

Hope you get some answers soon. My best guess would be an error in payroll. It would be pretty outrageous for them to just send you your P45 like that and you would be comfortably able to challenge them.

How horrible! I hope it is a mistake.

Try not to panic, it could be a genuine mix up with your payroll number. If you were being let go your last wage should have included a decent amount of accrued holiday pay if you didn't use it all before you went on mat leave. Did it?

If you don't get a quick and satisfactory response, I'd get this thread moved to the employment topic where there are some great HR and employment law experts.

Although saying that, the type of employer that would pull a stunt like this is unlikely to pay you your accrued holiday pay! I would err on the side of genuine mistake until you know more.

I have read some pretty outrageous stuff on here over the years but I think this has to be a genuine mistake.
Try not to overthink until the morning.

People saying it’s an error, are you missing where OP has been removed from the WhatsApp group? Bit of a coincidence

Report
scaryfrogfish · 17/09/2020 19:01

Do you know if you were removed recently from the WhatsApp group or if it was done whilst you were on mat leave so they didn't spam you with work stuff?

Report
Shaniac · 17/09/2020 19:01

Hopefully they rectify this immediately. Surely the p45 alone is a mistake but the having you deleted from the work group i assume whatsapp? Weird and sounds illegal.

What appears to be my final payslip has come with it stating holiday pay is due to be paid on the 29th sept which is my monthly pay day

Wow. This is outrageous if it’s not a mistake.

Go on their website now and see if any vacancies are being advertised OP. Might give you an idea if they are letting you go or advertising for a replacement. Screen shot it if you find anything!

I think you need to get legal advice asap. Are you sure you haven't missed any comms re redundancies etc. ?

Does seem like they have ended your employment. Are you friends with anyone at work who you can ask if they have heard anything.

If they haven't followed a fair process then you would certainly have grounds to claim against them

Oh wow, I hope it’s just a mistake, surely no company would do this on purpose??

Bunch of bellends they are! Apparently my boss’ niece is due to start in the next 2 weeks, according to my friend from work. No one I’ve asked has heard anything they were shocked when I told them

I would contact ACAS, if this isn't a mistake you'll have a very good case for a tribunal as this hasn't followed the Code of Practice at all
